RESOLUTION NO. 719 -79
A RESOLUTION OF THE SOUTH BEND COMMON COUNCIL
DECLARING CERTAIN PORTIONS OF THE DOWNTOWN AREA
OF SOUTH BEND, INDIANA, TO BE AN URBAN DEVELOP-
MENT AREA FOR PURPOSES OF I.C. 06 -1.1- 12.1 -1
THROUGH I.C. 96 -1.1- 12.1 -6 INCLUSIVE.
WHEREAS, upon investigation of the condition of the
downtown area of South Bend, Indiana, the Common Council
of South Bend, Indiana has found:
1. That the downtown area of South Bend,
Indiana, as specifically herein described,
has become blighted to such an extent that
such conditions cannot be corrected by
regulatory processes, or by the ordinary
operations of private enterprise, without
resort to the special provisions under state
law benefiting urban development areas.
2. That the public health and welfare will
be benefited by the redevelopment of such
area under the provisions of state law
benefiting urban development areas.
3. That the downtown area of South Bend,
Indiana, with respect to which these findings
are made is the area bounded as follows:
Commencing at the intersection of the
centerline of East Washington Street
and the centerline of St. Joseph Street
in South Bend, Indiana; thence northerly
along the centerline of St. Joseph Street
to the centerline of East Colfax Avenue;
thence westerly along the centerline of
East Colfax Avenue to its intersection
with the centerline of Michigan Street
as formerly existing (which such point
is located 41.25 feet North and 49.5 feet
East of the Northeast corner of Lot No. 13
in the Original Plat of South Bend, Indiana);
thence southerly along the centerline of
what was formerly known as Michigan Street
to the centerline of Washington Street;
thence easterly along the centerline of
Washington Street to the intersection
with the centerline of St. Joseph Street
and the point of beginning.
4. That the designation of such downtown area as an
urban development area for purposes of I.C. §6 -1.1- 12.1 -1
through I.C. §6 -1.1- 12.1 -6, inclusive will materially
benefit the city and inhabitants of South Bend, Indiana,
by significantly encouraging the construction, recon-
struction, improvement, and general development of the
downtown area and the buildings and land situated
therein.
Now, therefore, on the basis of such findings, and after such
investigation duly made by this Common Council, BE IT HEREBY
RESOLVED:
1. That the above- described downtown area of South
Bend, Indiana is declared a blighted area constituting
a menace to the social and economic interest of the
City of South Bend, Indiana and its inhabitants.
2. That it will be of public utility and benefit to
encourage redevelopment of the area through the pro-
visions of I.C. 36 -1.1- 12.1 -1 through I.C. §6 -1.1- 12.1 -6,
inclusive.
3. That such area so described is hereby declared and
found to be an Urban Development Area for purposes of
I.C. §56 -1.1- 12.1 -1 through I.C. 66 -1.1- 12.1 -6, in-
clusive, which area in South Bend, Indiana is located
within the following general boundaries:
Commencing at the intersection of the
centerline of East Washington Street
and the centerline of St. Joseph Street
in South Bend, Indiana; thence northerly
along the centerline of St. Joseph Street
to the centerline of East Colfax Avenue;
thence westerly along the centerline of
East Colfax Avenue to its intersection
with the centerline of Michigan Street
as formerly existing (which such point
is located 41.25 feet North and 49.5
feet East of the Northeast corner of Lot
No. 13 in the Original Plat of South Bend,
Indiana); thence southerly along the

TO: MEMBERS OF COMMON COUNCIL OF SOUTH BEND, INDIANA
It is respectfully requested that with respect to the
resolution which appears on the agenda of tonight's meeting of
the Common Council of South Bend, Indiana, as item 9A, if the
Common Council determines to limit the real estate covered by
such resolution to the land involved in the Hole Project (First
Bank and Trust Company of South Bend and Marriott Hotel land),
a motion should be made to change the legal description of the
real estate where such appears in both places in such resolution
to read as follows:
Commencing at the intersection of the centerline of East
Washington Street and the centerline of St. Joseph Street
in South Bend, Indiana; thence northerly along the centerline
of St. Joseph Street to the centerline of East Colfax Avenue;
thence westerly along the centerline of East Colfax Avenue
to its intersection with the centerline of Michigan Street as
formerly existing; (which such point is located 41.25 feet

Main Street to the south right -of -way line
of Monroe Street; thence east along the
south right -of -way line of Monroe Street to
the west right -of -way line of Fellows Street;
thence south along the west right -of -way line
of Fellows Street to the south right -of -way
line of Monroe Street; thence east along the
south right -of -way line of Monroe Street and
proceeding in a northeasterly direction along
said right -of -way line to the center of the
St. Joseph River; thence proceeding in a north-
westerly direction along the center of the St.
Joseph River to the north right -of -way line of
LaSalle Avenue; thence west along the north
right -of -way line of LaSalle Avenue to the west
right -of -way line of Main Street which is the
point of beginning; a map of which area is at-
tached hereto and incorporated herein by reference.
4. That the designation of such downtown area as an
urban development area for purposes of I.C. §6- 1.1- 12.1 -1
