1 <br />1 <br />1 <br />May 25, 1964 <br />A regular meeting of the Board of Public Safety was held on Monday, May <br />25, 1964 at 10:00 A.M. All members were present. Minutes. of the last <br />regular meeting were read and approved. Vouchers were approved and <br />ordered paid to the various suppliers. <br />REPORT ON HEAR_RIN�G_ VIOLATION OF RULES AND REG-ULATIONS OF THE FIRE <br />DEPARTMENT( JOHN E. CUNNINGHAM ) <br />The Board of Public Safety, pursuant to notice issued to Mr. John E. <br />Cunningham of the Fire Department, residing at 1256 E. McKinley Avenue, <br />said notice being dated May 180 1964, convened at 9:00 A.M. upon the charges <br />contained in that:notice. <br />All members of the Board were present. Also present were Fire Chief Cecil <br />C. McHenry, battalion Chief Harold Zyski and Captain Ray Arendt. Mr. <br />John E. Cunningham was present in person and by his counsel, Mr. J. W. <br />Oberfell. <br />The following is a copy of the notice sent to Mr. Cunningham: <br />Mr. John E. Cunningham <br />1256 E. McKinley Ave. <br />South Bend, Ind. <br />Dear Mr. Cunningham: <br />On the lgth day of May, 1964, Cecil C. McHenry, Chief of the South Bend <br />Fire Department, filed with the Board of Public Safety his complaint against <br />you wherein he states that you are now under suspension for violation of <br />Article XII, Section 30 of the Rules and Regulations of the Fire Department. <br />Such violation, in the main, consists of habitual failure to report for <br />work and duty at the hours and times prescribed by the Board and without <br />permission for such absences. <br />This is to inform you that the Chief of the Fire Department has requested <br />the Board of Public Safety that disciplinary action be taken against you <br />and the Board of Public Safety has fixed Monday morning, May 25, 1964 at <br />9:00 A.M. at the City Hall of the City of South Bend as the time and place <br />for such hearing. <br />Yourfailure to appear at said hearing will result in a hearing being held <br />in your absence and appropriate action being taken. <br />Very truly yours, <br />(S) Robert J. DuComb, Chairman <br />BOARD OF PUBLIC SAFETY <br />This notice came to hand this 19 day of May, 1964, and I served the same <br />on John E. Cunningham this 19 day of May, 1964. <br />(S) Glenn Terry <br />At the request of the defendant through his attorney, a continuance was <br />granted to 2:00 P.M. on June 11 1964. <br />REQUEST: ANNUAL FIREMEN'S BALL <br />Through the Chairman, Stanley Sparazynski, permission was requested.to hold <br />the annual Firemen's Ball on September 12, 1964 at the University of Notre <br />
