casualty or any other cause, shall be the sole expense and re- sponsibility of the City of South Bend, Indiana, which shall keep the property in a good state of repair during the entire term of the Lease /Purchase Agreement. Lessor's interest in the building and its liability shall be insured under a policy providing limits acceptable to Bidder. The City of South Bend, Indiana shall have the right under the Lease /Purchase Agreement to purchase the pro- perty at any time during the term of the lease for the amount paid for the property by bidder, plus interest to the date of repurchase. The Lease /Purchase Agreement shall contain such other terms and con- ditions-as may be appropriate in opinion of counsel for the City and Youth Facilities, Inc. All expenses of closing the purchase shall be paid by City of South Bend, and the City shall prepare all legal documents. Respectfully submitted.
