REGULAR MEETING DECEMBER 22.2016 407 <br />OPENING AND AWARD OF QUOTATIONS SOUTH BEND FIRE DEPARTMENT <br />STATION EXHAUST REMOVAL E AJIPMENI' (,FIRE DEPARTMENT SMALL <br />EQUIPMENT) <br />Mr. Gilot advised that this was the date set for the receiving and opening of sealed quotations for <br />the above referenced project. The following quotations were opened and read: <br />HASTINGS AFR ENERGY CONTROL INC. <br />5555 S Westridge Drive <br />New Berlin, WI 53151 <br />Quotation was submitted by DuWayne Bohrer <br />QUOTATION: $19,780.00 <br />AIR CLEANING SYSTEMS INC. <br />8 Sunset Drive <br />Latham, NY 12110 <br />Quotation was submitted by Anthony Milanese III <br />QUOTATION: $25,800 (Quote Paperwork not Properly filled Out) <br />Upon a motion made by Ms. Doran, seconded by Mr. Mueller and carried, the above quotations <br />were referred to the Fire Department for review and recommendation. After reviewing those <br />quotes, Mr. Todd Skwarcan, Fire Department, recommended that the Board award the contract to <br />the lowest responsive and responsible quoter, Hastings Air Energy Control, Inc., in the amount <br />of $19,780. Therefore, Mr. Gilot made a motion that the recommendation be accepted and the <br />quotation be awarded and the contract approved as outlined above. Ms. Doran seconded the <br />motion, which carried. <br />AWARD BID — ONE (1) OR MORE, 2016 OR NEWER ONE TON TWO -WHEEL DRIVE <br />DUMP TRUCK (WATER WORKS CAPITAL) <br />Mr. Jeff Hudak, Central Services, advised the Board that on December 13, 2016, bids were <br />received and opened for the above referenced truck. After reviewing those bids, Mr. Hudak <br />recommended that the Board award the contract to the lowest responsive and responsible bidder <br />Jordan Ford, 609 E Jefferson Boulevard, Mishawaka, IN 46545, in the amount of $48,493. <br />Therefore, Ms. Dorau made a motion that the recommendation be accepted and the bid be <br />awarded as outlined above. Mr. Mueller seconded the motion, which carried. <br />AWARD BID — WASTEWATER TREATMENT PLANT DIGESTER GAS UTILIZATION — <br />PROJECT NO 116.05OR (WASTEWATER CAPITAL IMPROVEMENTSIOTHER <br />CONTRACT(JAI, SERVICES) <br />Mr. Jacob Klosinski, Environmental Services, advised the Board that on December 8, 2016, bids <br />were received and opened for the above referenced project. After reviewing those bids, Mr. <br />Klosinski recommended that the Board award the contract to the lowest responsive and <br />responsible bidder Thieneman Construction Co., Inc., 17219 to <br />Parkway, Westfield, IN <br />46074, in unit prices not to exceed $754,000. Therefore, Ms. Doran made a motion that the <br />recommendation be accepted and the bid be awarded as outlined above. Mr. Mueller seconded <br />the motion, which carried. <br />AWARD BID — FIRE STATION NO 4 — PROJECT NO 116 06 (RWDA TIF) <br />Mr. Kevin Fink, Engineering, advised the Board that on December 13, 2016, bids were received <br />and opened for the above referenced project. After reviewing those bids, Mr. Fink recommended <br />that the Board award the contract to the lowest responsive and responsible bidder Gibson -Lewis. <br />LLC, 1001 W 1 lth Street, Mishawaka, IN 46544, in the amount of $3,057,900 for the Base Bid <br />plus Alternates 7, 8 and 9. Representatives from Gibson Lewis were present. Attorney Shawn <br />Ryan stated Gibson -Lewis had sent communication to the city requesting to withdraw their bid. <br />Mr. Ryan stated Mr. Lingenfelter, Gibson Lewis, LLC, sent a letter informing the engineer of a <br />clerical error in their bid. He explained they discovered after the bid opening that a portion of the <br />project that should have been included, was left out. He noted it reduced their bid over $200,000, <br />He stated he provided legal precedence from Indiana law and other States that allows a bid to be <br />released in the presence of a clerical error. He stated rather than buyer's remorse, in Indiana the <br />general rule is that clerical errors are excusable mistakes that allow release from a bid. He noted <br />that is the basis for the withdrawal and that was communicated with the City's Legal Department <br />
