Engineering states excavation and occupancy permits must be <br />obtained prior to any work in the right-of-way and the drain installation must be inspected by the <br />Engineering Department prior to backfilling. The encroachment shall remain in the right of way <br />until the time as the Board of Public Works of the City of South Bend shall determine that such <br />encroachment is in any way impairing or interfering with the highway or with the free and same <br />flow of traffic. Upon a motion made by Ms. Doran, seconded by Mr. Mueller and carried, the <br />Revocable Permit was approved subject to meeting Engineering's requirements. <br />APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — 209 NORTH MAIN <br />_ STREET <br />Mr. Gilot stated an application for a Revocable Permit has been received from Great Lakes <br />Capital Development, 112 W. Jefferson Blvd., Ste. 200, South Bend, Indiana for the purpose of <br />allowing the installation of a glass and steel entrance canopy at 209 North Main Street, Mr, Gilot <br />noted the request for the encroachment received all favorable recommendations. The <br />encroachment shall remain in the right of way until the time as the Board of Public Works of the <br />City of South Bend shall determine that such encroachment is in any way impairing or <br />interfering with the highway or with the free and same flow of traffic. Upon a motion made by <br />Mr. Mueller, seconded by Ms. Dorau and carried, the Revocable Permit was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE EAST WEST <br />PORTION OF JEFFERSON BLVD. NORTH OF THOMAS S'L SOUTH OF WASHINGTON <br />ST.. EAST OF LAUREL STREET <br />Mr. Gilot indicated that Mr. Brandon Anderson, on behalf of The History Museum, 808 W. <br />Washington Street, South Bend, has submitted a request to vacate the above referenced alley. <br />Mr. Gilot advised the Board is in receipt of favorable recommendations concerning this Vacation <br />Petition from the Area Plan Commission, Police Department, Fire Department, Solid Waste and <br />Community Investment. Mr. Gilot advised the Board is in receipt of unfavorable <br />recommendations concerning this Vacation Petition from the Engineering Department. <br />Engineering states this would create a dead-end north/south alley and would limit access to <br />vacant lot at 915 Jefferson Boulevard. Area Plan stated the vacation would not hinder the growth <br />or orderly development of the unit or neighborhood in which it is located or to which it is <br />contiguous. The vacation would not make access to the lands of the aggrieved person by means <br />of public way difficult or inconvenient. The vacation would not hinder the public's access to a <br />church, school or other public building or place. The vacation would not hinder the use of a <br />public right -of --way by the neighborhood in which it is located or to which it is contiguous. The <br />Board reviewed the map and determined the alley affected is a very small alley and d vacated, e <br />would be wise to vacate the north/south alley also to prevent a dead-end alley. Therefore; Mr. <br />it <br />Gilot made a motion recommcrtding approval of the request for vacation.
