2'/24 /7.0 AGREEMENT WITH PENN CENTRAL R-:'Sianalization at Olive and Washington Upon recommendation of the Traffic Director, it was moved, seconded and unanimously carried to approve the. Agreement between the City and Penn.Central for the interconnection (and its construction and maintenance) of the City's vehicular traffic control -devices with Penn Central's automatic crossing protection circuits for grade crossing of the Company's main line tracks and Olive Street. The Agreement.is filed with the Board. AREA PLAN COMMISSION RECOMMENDATION AND ADOPTION OF VACATION RESOLU- TION No. 3308, 1970 -- Don F. Hickey Area Plan Commission recommends to the Board the vacation of'north and south alley running south from Lincoln Way West. And the Board, upon, motion made, seconded and unanimously carried, adopts Resolution No. 3308, 1970 as follows: RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA., that it is desirable to vacate the following: The north and south alley lying between Lots #2 and 44 Chapins Sub. of B.O.L. 4+182 and running south from the south line of Lincoln Way West to the southeast corner of Lot #2 and the southwest corner of Lot #4, Chapins Sub. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation: Lots #1 to #11 inclusive in Chapins Sub, of B.O.L. 4182 and Lots #13, 14, 15, 16, 17 Rebecca Studebakers Sub.,&and a parcel of land lying west and adjacent to Lots #1 and #3 Chapins Sub. of B.O.L. #182 and running from Lincoln Way West to LaSalle Avenue. Notice of this Resolution shall be published on the 27th day of February, 1970 and the 6th day of March, 1970, in the South Bend Tribune and in the Tri-County News. This Board at its office, on the 16th day of March, 1970, at 9:30 A.M. will hear and receive remonstrances from all persons interested in or affected by these proceedings. EXCAVATION BOND -- Louis M. Seago, d/b/a Seago's Remodeling Service, The Clerk was instructed to return the Excavation Bond on behalf of Louis M. Seago for proper execution by the Surety.
