January 19, 1970 <br />It was moved, seconded and carried that the owner be permitted to employ a <br />private contractor for the demolition of the structure at 421-423 S. Will°iam <br />Street on condition that the owner pay $25.00 into the office of the Sub - <br />Standard Division of the Building Department for payment to the low bidder <br />(Bryant Excavating Company) under the bids now opened as.a condition precedence <br />to a permit, and on the second condition that demolition be completed within <br />30 days from January 19, 1970, as would have been required under the bids sub- <br />mitted to the City. <br />ANNUAL REPORT;FILED - SUB -STANDARDS DIVISION, BUILDING DEPARTMENT <br />The annual report for 1969 of the Sub -Standards Division of the Building De- <br />partment was reviewed by the Board and ordered filed. <br />REQUEST FOR SUB -STANDARD PROPERTY OWNERS TO APPEAR BEFORE BOARD 2/2/70 <br />Upon motion made, seconded and carried, the Board approved the request of the <br />Sub -Standards Director for the following persons to appear before the Board on <br />February 2, 1970, to show cause, if any they have, why the following properties <br />should not be demolished: <br />Portage Realty Co. 524 E. Broadway <br />American National Bank 712 E. Madison Street <br />Basil and Velma Ziglear 830 S. Marietta St. <br />Sam and Esther Caparell 2625 W. Linden Ave. <br />CONTRACT AWARDED FOR STREET SWEEPERS <br />Upon motion made, seconded and carried, the Board approved the recommendation <br />of Street Commissioner R. B. Gartner for award of contract for two Diesel <br />powered street sweepers to Ries Equipment Company on their bid of $33,280.00 <br />on January 12, 1970. <br />ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3307 - MOSSBERG & COMPANY <br />Lloyd S. Taylor, City Engineer, files assessment roll showing award of damages <br />and assessment of benefits in Vacation Resolution No. 3307, being for the <br />vacation of: <br />the north -south alley between Tutt and Sample Streets and the <br />east -west alley between Carroll and Fellows Streets, more par- <br />ticularly described as: <br />Beginning at the southeast corner of Lot 6 of William S. <br />Anderson's Subdivision in the City of South Bend, Indiana; <br />thence north along the east line of said Lot 6 to the north- <br />east corner thereof; thence east along the north line of <br />lots 5, 4, 3 and 2 in said Subdivision to the southwesterly <br />line of Tutt Street; thence northwesterly along the south- <br />westerly line of Tutt Street to the southeast corner of Lot <br />12 in said Subdivision; thence west along the south line of <br />Lots 12, 11 and 10 to a point on the west line of said Lot 6, <br />as extended northerly; thence south to the northwest corner <br />of said Lot 6; thence east on the north line of said Lot 6 <br />to a point 14 feet west of the northeast corner of said Lot <br />6; thence south on a line parallel with and 14 feet west of the east <br />line of said Lot 6, to the south line of said Lot 6; thence east <br />14 feet to the place of beginning, in St. Joseph County, <br />Indiana. <br />Reserving the rights and easements of all utilities and the <br />Municipal City of South Bend, Indiana, to construct and maintain <br />any facilities, including, but not limited to, the following: <br />electric, telephone, gas, water, sewer, surface water control <br />structures and ditches within the vacated right of way, unless <br />such rights are released by the individual utilities. <br />The following property may be injuriously or beneficially <br />affected by such vacation: <br />Lots 2, 3, 4, 5, 6, 10, 11 and 12 of William S.
