<br />395, 1007 and 1008 in the recorded Second Plat of LaSalle
<br />Park, a Subdivision in the northeast Quarter of Section 9,
<br />and the Southwest Quarter of Section 10, Township 37 north,
<br />Range 2 east, an Addition to the City of South Bend, Indiana.

<br />And the Board sets 9:30 A.M. on the 9th day of February, 1970, as the time
<br />for receiving remonstrances from persons interested in or affected by such
<br />vacation. And the Clerk is directed to give notice by publication in the
<br />South Bend Tribune and the Tri County News on January 16, January 23 and
<br />January 30, 1970.
<br />HEARING ON VACATION RESOLUTION NO. 3307 - MOSSBERG & COMPANY
<br />This being the date set, hearing was held on Vacation Resolution No. 3307
<br />adopted by the Board on the 29th day of December, 1969, for the vacation of
<br />the north -south alley between Tutt and Sample Streets and the east -west
<br />alley between Carroll and Fellows Streets, more particularly described as:
<br />Beginning at the southeast corner of Lot 6 in William S.
<br />Anderson's Subdivision, in the City of South Bend, Indiana;
<br />thence north along the east line of said Lot 6 to the north-
<br />east corner thereof; thence east along the north line of
<br />Lots 5, 4, 3 and 2 in said Subdivision to the southwesterly
<br />line of Tutt Street; thence northwesterly along the south-
<br />westerly line of Tutt Street to the southeast corner of Lot
<br />12 in said Subdivision; thence west along the south line of
<br />Lots 12, 11 and 10 to a point on the west line of said Lot 6,
<br />as extended northerly; thence south to the northwest corner
<br />of said Lot 6; thence east on the north line of said Lot 6
<br />to a point 14 feet west of the northeast corner of said Lot 6;
<br />thence south on a line parallel with and 14 feet west of the
<br />east line of said Lot 6 to the south line of said Lot 6;
<br />thence east 14 feet to the place of beginning, in St. Joseph
<br />County, Indiana.
<br />The Clerk tendered proofs of publication of notice in the South Bend Tribune
<br />and the Tri County News on January 2 and January 9, 1970, which were read and
<br />found to be sufficient.
<br />Jack C. Dunfee, attorney for the petitioner Mossberg and Company, appeared
<br />before the Board. Also attending were Mrs. George Franklin, 310 E. Sample
<br />Street, Ruben From, 401 E. Sample Street, Robert Ziker, 251 E. Sample Street
<br />and three or four others, who had no objection to the vacation.
<br />Mr. Dunfee presented a drawing of the alleys and the surrounding area and
<br />explained the reason for the requested vacation that petitioner Mossberg Company
<br />wished to reroute its traffic. No remonstrances, oral or written, having been
<br />received, upon motion made, seconded and unanimously carried, the resolution
<br />was approved as adopted. And the City Engineer was directed to prepare an
<br />assessment roll covering the assessment of benefits and the award of damages
<br />to the surrounding property owners.
<br />AWARD OF CONTRACT FOR AERIAL LADDER TRUCK - FIRE DEPARTMENT
<br />All bids received December 8, 1969, for a tractor drawn aerial ladder truck
<br />for the Fire Department having been considered, upon motion made, seconded
<br />and unanimously carried, the Board approved the recommendation of Fire Chief
<br />Joseph L. Zurat for the award of contract to American LaFrance, Division of
<br />"Automatic" Sprinkler Corporation of America, Elmira, New York, 14902, on
<br />its net bid of $55,556.00 (f.o.b. factory by R.R. freight in enclosed boxcar,
<br />260 working days after receipt of executed contract --warranty 3 years on parts,
<br />one year on labor).
