9/15/69 <br />A tract of land located in the east one-half of Section 4, <br />Portage Township, beginning on the north line of Prast Boulevard <br />as now exists at a point 3.02 feet west of the west line of <br />Illinois Street; thence west on and along the north line of said <br />Prast Boulevard a distance of 480.29 feet to its intersection <br />with the southerly line of Ardmore Trail; thence south 63 degrees <br />and 22 minutes west on and along said southerly line of Ardmore <br />Trail a distance of 108.162 feet to its intersection with the <br />easterly line of Sheridan Avenue; thence south on and along <br />said east line of Sheridan Avenue a distance of 31.51 feet to <br />its intersection with the south line of Prast Boulevard; thence <br />east on and along said south line of Prast Boulevard a distance <br />of 576.98 feet to a point 3.02 feet west of the west line of <br />Illinois Street; thence north parallel and 3.02 feet west of the <br />west line of Illinois Street a distance of 80 feet to the place <br />of beg.inning, containing an area of 44,929.25 square feet, more <br />or less. <br />having been taken under advisement on September 8, 1969, and having been <br />duly considered, the motion was made, seconded and unanimously carried <br />to finally adopt said Resolution, subject to the dedication of a tract <br />. of land for the relocation of a portion of Prast Boulevard as set out in <br />the 'Offer to Dedicate" filed with the Board by the petitioner on May 12, <br />1969, as follows: <br />"OFFER TO DEDICATE A TRACT OF LAND FOR THE <br />RELOCATION OF A PORTION OF PRAST BOULEVARD <br />May 12, 1969 <br />The Bendix Corporation (hereinafter referred to as "Bendix") <br />hereby represents and certifie 4 that it is the legal owner of <br />Lots 176 and 177, Westchester Second Unit, East One -Half, Section <br />4, Township 37 north, Range 2 east, Portage Township, South Bend, <br />Indiana; and <br />WHEREAS, the City of South Bend, Indiana, desires to re- <br />locate a portion of Prast Boulevard, a public street, from <br />Illinois Street to its present intersection with Sheridan Avenue <br />and Ardmore Trail, to a proposed intersection with Ardmore <br />Trail; and <br />WHEREAS, Bendix has caused to be filed with the Board of <br />Public Works and Safety of the City of South Bend, Indiana, a <br />petition to vacate a certain portion of Prast Boulevard between <br />Illinois Street and the intersection of Sheridan Avenue and Ardmore <br />Trail, South Bend, Indiana, wherein the portion of Prast Boulevard <br />to be vacated under that petition would revert to the ownership <br />of Bendix as an extension of the above described Lots 176 and 177; <br />and <br />WHEREAS, the relocation of a portion of Prast Boulevard to <br />a proposed intersection w"th Ardmore Trail would require the re- <br />dedication of a portion of the land vacated under the above <br />described petition, as well as the dedication of a portion of <br />the above described Lot 176, <br />NOW, THEREFORE, Bendix does hereby offer and agree to give, <br />warrant, grant, bargain, sell and convey unto the City of South <br />Bend, Indiana, for the sum of $1.00 and other good and valuable <br />considerat'on, the tract of land described as follows, to -wit: <br />A tract of land located in the east one-half of <br />Section 4, Portage Township, beginning on the north <br />line of Prast Boulevard as now exists at a point 3.02 <br />feet west of the west line of Illinois Street, said <br />
