May 19, 1969 <br />A regular meeting of the Board of Public Works and Safety convened at 10:00 <br />A.M., on May 19, 1969, with all members present. The minutes of the previous <br />meeting were reviewed and approved. <br />POLICE OFFICER CULLEN WALTON - SUSPENDED 138 DAYS <br />On the plea of "guilty" heretofore entered by Cullen Walton, the Board of <br />Public Works and Safety now hereby suspends officer Walton for a period of <br />138 days, with loss of all pay and allowances, commencing April 16, 1969. <br />The officer is to report for duty September 1, 1969, at 8:00 A.M. Police <br />Chief Thomas McNaughton and officer Cullen Walton were present at the meeting. <br />PRELIMINARY HEARING - VACATION RESOLUTION NO.3279, 1969 - CHARLES NIBLICK <br />This being the date set, hearing was held on Vacation Resolution No. 3275, <br />1969, adopted on the 5th day of May, 1969, being a petition for the vacation <br />of: <br />The first east -west alley north of Marion Street from <br />Scott Street east to the north -south alley between Scott <br />Street and Leland Avenue, situated between Lots No. 25 <br />and 26 in James D. Kent's Sub, of Bank Out Lot 114. <br />Proofs of publication in -the South Bend Tribune and Tri County News on May <br />9 and May 16, 1969, were read and found to be sufficient. Attorney Timothy <br />Woods appeared before the Board on behalf of the petitioner. No other persons <br />appeared for or against the vacation, and no remonstrances having been received, <br />upon motion made, seconded and unanimously carried, the resolution for the <br />vacation of said property was finally adopted, and the City Engineer was <br />directed to prepare an assessment roll covering the assessment of benefits and <br />the award of damages to surrounding property owners. <br />PRELIMINARY HEARING - VACATION RESOLUTION NO. 328a, 1969 - STEPHEN G. BOSKEY <br />This being the date set, hearing was held on Vacation Resolution No. 3280, <br />1969, adopted May 5, 1969, being a petition for the vacation of: <br />EAST -WEST ALLEY BETWEEN LOTS 235 AND 228 OF NORTHWEST THIRD PLAT <br />Beginning at the southwest corner of Lot 235 of said North- <br />west Third Plat; thence easterly on and along the south line <br />of said Lot 235 a distance of 240 feet more or less to the <br />southeast corner of said Lot 235; thence south a distance of <br />14 feet to the northeast corner of Lot 228 of said northwest <br />Third Plat; thence westerly on and along the north line of <br />said Lot 228 a distance of 240 feet more or less to the north- <br />west corner of said Lot 228; thence north 14 feet to the south- <br />west corner of Lot 235 and the point of beginning. <br />NORTH -SOUTH ALLEY BETWEEN LOTS 235 AND 236 AND 228 AND 227 OF <br />NORTHWEST THIRD PLAT. Beginning at the northeast corner of Lot <br />235 of said northwest Third Plat; thence south on and along <br />the east line of Lot 235 a distance of 270 feet more or less <br />to the southeast corner of Lot 228; thence east a distance <br />of 14 feet to the southwest corner of Lot 227 of said Northwest <br />Third Plat; thence north on and along the west line of Lot 227 <br />and 236 a distance of 270 feet more or less to the northwest <br />corner of said Lot 236; thence west 14 feet to the northeast <br />corner of Lot 235 and the point of beginning. <br />PART OF ROSE STREET BETWEEN LOTS 225 AND 228 OF NORTHWEST <br />THIRD PLAT. Beginning at the southwest corner of Lot 228; <br />thence east a distance of 254 feet more or less to the south- <br />west corner of Lot 227; thence south 60 feet to the northwest <br />corner of Lot 226; thence westerly a distance of 254 feet more <br />or less to the northwest corner of Lot 225; thence north 60 <br />feet to the southwest corner of Lot 228 and the point of be- <br />ginning. <br />Proofs of publication in the South Bend Tribune and Tri County News on May <br />9 and May 16, 1969, were read and found to be sufficient.
