10/19/70 <br />Reserving the rights and easements of all utilities and the municipal <br />city of South Bend, Indiana to construct and maintain any facilities, in- <br />cluding but not limited to the following: electric, telephone, gas, -sewer, <br />surface water control structures and ditches, within the vacated right of <br />way unless such rights are released by the individual utilities. <br />The follwoing property may be injuriously or beneficially affected <br />by such vacation: <br />The area bounded on the east by Kemble Avenue and Prairie Avenue, <br />on the south by Cotter Street, on the west by Kendall Avenue <br />and on the north by Penn Central and New Jersey, Indiana and <br />Illinois Railroad Company. <br />Notice of this resolution shall be published on the '23rd day of <br />October and on the 30th day of October, 1970, in the South Bend Tribune <br />and in the Tri County News. <br />e-4 <br />This Board, at its office, on <br />the 2nd day <br />of November, 1970, at <br />00 <br />9:30 A.M., will hear and receive remonstrances <br />from all persons <br />interested in or affected by these <br />proceedings. <br />Q <br />Adopted this 19th day of October 1970. <br />BOARD OF PUBLIC <br />WORKS AND SAFETY <br />L. Chapleau, attorney, on behalf of Jerome F. Claeys, Jr. and Don H. <br />Claeys files a petition to vacate the following two alleys: <br />An east -west public alley extending from Taylor Street <br />westerly, which alley is the first alley north of South <br />Street,.and is bordered on the south by Lot 1 as shown <br />on the recorded plat.of Touhey and Hagerty's Subdivision <br />of Bank Out Lot 59 of.the first plat of Out lots of the <br />town, now city, of South Bend. <br />A public alley running in a northerly and southerly . <br />direction, being the first alley west of Taylor Street <br />and extending northerly from South Street, which said <br />alley is bordered on the east by Lots 1, 2, 3 and 4 <br />as shown on the recorded plat of Touhey and Hagerty's Sub- <br />division of Bank Out Lot 59 6f the first plat of Out Lots <br />of the°town, now city, of South Bend. <br />and submits check in the amount of $65.00 for costs. Upon motion made, <br />seconded and carried, the petition is referred to the Engineering Department <br />for the location of utilities and then to be referred to Area Plan Commission <br />for study and recommendation to the Board. <br />751 S. MICHIGAN STREET - SIDEWALK REPAIR (SUBSTANDARDS DEPARTMENT) <br />Upon motion made, seconded and unanimously carried, quotations for repair <br />of the sidewalk at 751 S. Michigan Street were referred to the City Attooney <br />for further processing. <br />Upon motion made, seconded and unanimously carried, t-he meeting recessed <br />at 11:50 A.M., and reconvened at 2:30 P.M., with all members present. <br />
