Barbe, of the Department of Redevelopment, reported that all persons <br />had been contacted as requested by the Board on September 14, 1970, except <br />O'Dell Coates who was unavailable. <br />Mr. Barbe reports Mrs, Rose Baetsle, 126 N. Meade Street, and Mrs. Henry <br />Jones, 2629 W. Washington A:�enue, had been mistaken as to the alleys re- <br />ferred to and are now in agreement for the vacation; that Mrs. James Scott, <br />2629 Newcome Street, has a valid objection because of her business and he <br />therefore recommends that alley #9 be deleted from the vacation; that Leo <br />Verhaegen, 137 S. Meade Street, objects to the closing of alley #6 and <br />alley #8 as he plans to build a garage facing the alley. <br />Mvs:-.James..Scott, :2629rW, Washington Avenue, was present at .the meeting. <br />No one further appearing, the motion was made to amend Vacation Resolution <br />No. 3326, 1970, by deleting from it the alley marked #9 and the alleys <br />marked #6 and #8 (north -south alleys between Kaley and Meade Streets). The <br />motion was seconded and carried. <br />The motion was then made, seconded and carried, to adopt Vacation Resolution <br />No. 3326, 1970 as amended. <br />And the City Engineer was directed to prepare an assessment roll showing the <br />assessment of benefits and the award of damages to the surrounding properties. <br />HEARING ON VACATION RESOLUTION NO. 3329 - MIDWEST TURNKEY BUILDERS, INC. <br />This being the date set, hearing was held on Vacation Resolution No. 3329, <br />being for the vacation of: <br />Frances Street from the north line of Miner Street extending <br />north 105 feet to the south right of way line of a.12 foot <br />alley as shown on the recorded Plat of Lederer and Longley's <br />Subdivision of Out Lot numbered 1 in Samuel L. Cottrell's <br />First Addition to the town of Lowell, now a part of the city <br />of South Bend. This portion of the street was formerly <br />Lots 35 and 36 of said Addition. <br />The Clerk tendered proofs of publication in the South Bend Tribune and the Tri <br />County News on September 11 and September 18, 1970, which were read and found <br />to be sufficient. <br />Attorney Robert L. Miller, 112 Lafayette Building, South Bend, Indiana, and <br />Keith Slabaugh, 305 N. Studebaker Street, Mishawaka, Indiana, for Midwest <br />Turnkey Builders, Inc., appeared before the Board in favor of the vacation. <br />Attorney F. Jay Nimtz, 511 W. Colfax Avenue, South Bend, Indiana, appeared <br />before the Board on behalf of persons who signed a remonstrance filed with <br />the Board on September 8, 1970. <br />Approximately 18 other ;interested persons were present at the meeting. <br />Mr. Miller explained the purpose of the request to vacate the street was to <br />provide off street parking in connection with the turnkey project of the <br />petitioner. The residents complained that the closing of this portion of <br />Frances Street would create a bottleneck and would increase the traffic <br />problems that already exist and make it difficult or impossible to get to <br />their garages. Mr. Nimtz stated that the solution to the problem would be <br />to extend Frances Street. <br />Mr. Miller stated that Midwest Turnkey Builders, Inc. is willing to provide <br />a 14 foot easement as recommended by the Area Plan Commission, and there <br />followed a discussion as to the location of this easement. <br />
