<br />A regular meeting of the Board of Public Works and Safety convened at 5:50,
<br />A.M., on July 27, 1970, with S. J. Crumpacker, City Attorney, and James A.
<br />Bickel, City Controller, present. The minutes of the previous maoA g
<br />three meetings were reviewed and approved. Mr. Crumpacker acted as chairman
<br />of the meeting.
<br />The chairman stated,that in reference to charges filed against patrolman
<br />David L. Andrews on July 13, 1970, by Chief of Police Loren M. Bussert for
<br />violation of Sections 4.17, 4.5, 4.7 and 4.50 of the General Rules and -Regu-
<br />lations of the Police Department of the City of South Bend, Indiana, the
<br />Board has considered the matter and made its findings, and the findings of
<br />the Board were read aloud.
<br />At the conclusion of the reading of the findings of the.Board, it was moved
<br />that patrolman David L. Andrews be found guilty of the charges in Counts 11
<br />and 111. The motion was seconded and carried.
<br />It was further moved that on the finding of guilty to Counts I, II, 111 and V
<br />of the charges that patrolman David L. Andrews be dismissed from the South
<br />Bend Police Department effective July 16, 1970. The motion was seconded and
<br />carried.

<br />t Charles A. Sweeney, attorney for David L. Andrews, present at the meeting,
<br />stated that Mr. Andrews does not waive his right of appeal and that he will
<br />consult with Mr. Andrews regarding an appeal of the Board's verdict., Mr.
<br />Andrews was not present.
<br />FIRE DEPARTMENT_- RESIGNATION OF CALVIN JAMES EVERLY
<br />Upon motion made, seconded and carried, the Board accepted and approved the
<br />resignation of Calvin James Everly , upon the recommendation of Fire Chief
<br />Joseph L.. Zurat, effective as of July 24, 1970.
<br />FIRE DEPARTMENT - REQUEST FOR DEMONSTRATION AT CAMP EBERHART
<br />Upon motion made, seconded and carried, the Board approved the request of
<br />Fire Chief Joseph L. Zurat for firemen Dan Plencer, Victor Richart and Joe
<br />Zelinski to put on a first aid demonstration at Camp Eberhart, Three Rivers,
<br />Michigan,, on July-30, 1970, as'requested by the Y.M C.A., 1201 Northside
<br />Boulevard, South Bend, Indiana.
<br />FIRE DEPARTMENT - RETIREMENT OF JOSEPH W. MADARAS
<br />Upon motion made,. seconded and carried, the Board accepted and approved the
<br />retirement of fireman Joseph W. Madaras effective August 1, 1970, Mr. Madaras
<br />having been appointed to the Fire Department January 22, 1948, and having
<br />served 222 years.
<br />FIRE DEPARTMENT - REQUEST FOR TRANSFER OF $4,000.00
<br />Upon motion made, seconded and carried, the Board approved the request of
<br />Fire Chief Joseph L. Zurat for the transfer of $4,000.00 fran Account Q-1"1
<br />(services personal) to Account Q-43 (repair parts), and the request was
<br />referred to the Legal Department for the preparation of an ordinance for
<br />the consideration of the Common Council.
<br />POLICE DEPARTMENT - RETIREMENT OF MICHAEL SANTA
<br />Upon motion made, seconded and carried, the Board accepted and approved the
<br />retirement of Captain Michael Santa from the South Bend Police Department
<br />effective July 31, 1970, upon the recommendation of Chief Loren M. Bussert.
<br />POLICE DEPARTMENT - APPLICATIONS FOR APPOINTMENT
<br />The following applications for appointment to the South Bend Police Department
<br />were filed with the Board and referred to the Personnel Director for further
<br />processing:
