422 <br />8/21/72 <br />VACATION RESOLUTION NO. 3364,1972 <br />Area Plan Commission having filed with the Board its favorable <br />recommendation for the vacation of alleys, streets and easements <br />in area bounded by the south right of.way line of Linden Avenue, <br />the east right of way line of College Street, the West'h right of way <br />of Birdsell Street and the north right of way line of Orange Street <br />and this being the date set for hearing on the Vacation Resolution, <br />hearing is now held.. <br />The Clerk tendered proofs of publication of notice on the llth <br />day of August and the l8th day of August, 1972 in the South Bend <br />Tribune and the Tri County News and same were found to be sufficient. <br />No remonstrators having appeared and no written remonstrances having <br />been filed, but Mr. L. C. Nettles, 225 North College Street appeared <br />And asked for information. Mr. Nettles was assured the vacated <br />streets and alleys were not near his home, and his street was not <br />being vacated and he was satisfied. Thereupon, upon motion made, <br />seconded and carried the said Resolution adopted on the 7th day of <br />August, 1972 is ratified and confirmed and said streets and alleys <br />are vacated. <br />The City Engineer is.directed to prepare an assessment roll showing <br />the award of damages and the assessment of benefits to the surround- <br />ing properties. <br />AREA PLAN COMMISSION RECOMMENDATION - ST. PETER'S STREET <br />Area Plan Commission filed with the Board its favorable recommendation <br />for the vacation of St. Peter Street from the South right of way line <br />of Cedar Street south to the North right of way line of Madison Street. <br />Upon motion made, seconded and carried, the matter is now referred to <br />the Engineering Department for the preparation of a vacation resol- <br />ution. <br />PETITION TO VACATE MERRY AVENUE <br />A petition was received from the Redevelopment Commission asking for <br />the vacation of a tract of land bounded by Washington Street on the <br />North, Merry Avenue on the West and South and Grant Street on the <br />East. Upon motion duly made, seconded and carried the petition was <br />referred to the Engineering Department and the Area Plan Commission <br />for study and recommendation. <br />EXTRA WORK AGREEMENT - RIETH-RILEY CONSTRUCTION COMPANY <br />An extra work agreement on Cont. No. TX-8775, Project T-6000 (2) <br />in the amount of $185.00 was, upon motion made, seconded and carried <br />approved by the Board. <br />LETTER FROM ROGER PARENT - SOUTHEAST CORNER OF TWYCKENHAM AND CORBY <br />A letter was received from Councilman Roger Parent complaining that <br />the excavation on the southwest corner of Cedar and Arthur and one <br />on the southeast corner of Twyckenham and Corby Boulevards were still <br />open and a public hazard. Upon motion made, seconded and carried <br />these were referred to the Legal Department for appropriate action. <br />NOTICE OF WEEDS ON CITY OWNED PROPERTY <br />A notice was received from the Health Department that weeds over <br />twelve inches high were on a piece of property owned by the city at <br />1700 block South Grant Street.
