27 <br />J <br />1 <br />March 6, 1972 <br />A regular meeting of the Board of Public Works and Safety convened <br />at 9:30 A.M., on Monday, March 6, 1972. Present were William J. <br />Richardson, City Engineer and Charles A. Sweeney, Jr. City Attorney. <br />CHARGES AGAINST PATROLMAN THEODORE CEASAR NAJDEK <br />This being the date set for hearing charges against Patrolman Theodore <br />Ceasar Najdek, the hearing is now held. <br />Patrolman Najdek chose to represent himself. Upon questioning he <br />stated that he had received a copy of the charges against him, and <br />of notice of hearing. He waived the reading of Burns. Anno. Ind. <br />Statutes. The Chairman asked how he pled on Count 1 and Patrol -- <br />man Najdek pled guilty. The Chairman asked how he pled on Count <br />11 and Patrolman Najdek pled guilty. The Board now finds that <br />Patrolman Najdek, upon his plea, is found guilty. After reviewing <br />the case, and upon the recommendation of Chief Seals, his penalty <br />is assessed at seven days suspension without pay. Reinstatement <br />to be after seven days. Since seven days have elapsed since he <br />was first suspended, Patrolman Najdek is now reinstated and re- <br />turned to duty. <br />CHARGES AGAINST PATROLMAN LEONARD MICHAL GRUMMELL <br />This being the date set for hearing charges against Patrolman Leonard <br />Michael Grummell, the hearing is now held. <br />Comes now Arthur W. Goulet, Attorney, who appears before the Board <br />to represent Patrolman Grummell. The chairman requested that reading <br />Burns Anno. Indiana Statute Sec. 48-6105 be.waived. Attorney Goulet <br />waived the reading of the statute and stipulated that the Board has <br />the authority to act in this matter. <br />Patrolman Grummell stated that he had received a copy of the charges <br />against him and notice of the meeting. He denied both counts. Mr. <br />Goulet now files an answer to the Board in regard to the complaints, <br />as follows: <br />CITY OF SOUTH BEND ) <br />STATE OF INDIANA ) <br />IN THE MATTER OF ) <br />CHARGES AGAINST PATROLMAN) <br />LEONARD MICHAEL GRUMMELL ) <br />BEFORE THE BOARD OF PUBLIC <br />WORKS AND SAFETY OF THE CITY <br />OF SOUTH BEND, INDIANA <br />ANSWER <br />Comes now Patrolman Leonard Michael Grummell and for his <br />answer to Charges filed against him March 3, 1972 by Robert W. <br />Seals, Chief of Police for the city of South Bend, says: <br />1. That he denies the allegations contained in both <br />rhetorical paragraphs of Count 1 of said charges. <br />2. That he denies the allegations contained in both <br />rhetorical paragraphs of Count 11 of said charges. <br />WHEREFORE, said Leonard Michael Grummell prays that this <br />Board find in his favor and against the charges filed against him <br />herein. <br />s/ Arthur W.
