2i7e72 PETITOON TO VACATE THE FIRST NORTH -SOUTH ALLEY WEST OF IRONWOOD - INDIANA & MICHIGAN ELECTRIC COMPANY Indiana & Michigan Electric Company, by Jack C. Dunfee, Jr., Attorney, files its petition to vacate the first North -South alley West of Ironwood Drive, South of the Grand Trunk Western Railroad line South'a distance of One Hundred Thirty -Three and Forty -Five Hundredths (133.45) feet, and deposits $75.00 to pay for costs. Upon motion made, seconded and unanimously carried, the petition was referred, simultaneously, to the Engineering Department and the Area Plan Commission for study and recommendation to the Board. AREA PLAN COMMISSION RECOMMENDATION ADOPTION OF VACATION RESOLUTION NO. 3355,1972 Area Plan Commission files with the Board its recommendation for the vacation of the east -west alley between Colfax and Washington Avenue running West from the West line'of Niles Avenue 150' +- to the East line of the East Race, said alley running between Lots #45 and 46 in a part of the Original Plat of the Town of Lowell, now a part of the City of South Bend. Thereupon the following resolution was adopted: VACATION RESOLUTION NO. 3355, 1972 "RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to ;vacate the following: The east -west alley between Colfax and Washington Avenue running West from the West line of Niles Avenue 150' +- to the East line of the East Race, said alley running between Lots #45 and 46 in the part of the Origi.nal Plat of the town of Lowell, now a part of the City of South Bend. "Reserving the rights and easements of all futilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, in- cluding, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. "The following property may be injuriously or beneficially affected by such vacation: Lots 1 to 11 both included in Miller Green's 1st Addition to Lowell. Lots 25 and lots 43 to 48 both included and lots 91 to 96 both included in Original Plat of Lowell "Notice of this Resolution shall be published on the llth day of February, 1972, and the 18th day of February, 1972 in the South Bend Tribune and the Tri County News. "This Board, at its office, on the 22nd day of February, 1972 at 9:30 A.M., will hear and receive remonstrances from all persons interested in or affected by these proceedings.
