2i7e72 <br />PETITOON TO VACATE THE FIRST NORTH -SOUTH ALLEY WEST OF IRONWOOD - INDIANA & <br />MICHIGAN ELECTRIC COMPANY <br />Indiana & Michigan Electric Company, by Jack C. Dunfee, Jr., Attorney, files <br />its petition to vacate the first North -South alley West of Ironwood Drive, <br />South of the Grand Trunk Western Railroad line South'a distance of One Hundred <br />Thirty -Three and Forty -Five Hundredths (133.45) feet, and deposits $75.00 to <br />pay for costs. Upon motion made, seconded and unanimously carried, the petition <br />was referred, simultaneously, to the Engineering Department and the Area Plan <br />Commission for study and recommendation to the Board. <br />AREA PLAN COMMISSION RECOMMENDATION <br />ADOPTION OF VACATION RESOLUTION NO. 3355,1972 <br />Area Plan Commission files with the Board its recommendation for the vacation <br />of the east -west alley between Colfax and Washington Avenue running West from <br />the West line'of Niles Avenue 150' +- to the East line of the East Race, said <br />alley running between Lots #45 and 46 in a part of the Original Plat of the <br />Town of Lowell, now a part of the City of South Bend. <br />Thereupon the following resolution was adopted: <br />VACATION RESOLUTION NO. 3355, 1972 <br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH <br />BEND, INDIANA, That it is desirable to ;vacate the following: <br />The east -west alley between Colfax and Washington Avenue <br />running West from the West line of Niles Avenue 150' +- <br />to the East line of the East Race, said alley running <br />between Lots #45 and 46 in the part of the Origi.nal <br />Plat of the town of Lowell, now a part of the City of <br />South Bend. <br />"Reserving the rights and easements of all futilities and the Municipal <br />City of South Bend, Indiana, to construct and maintain any facilities, in- <br />cluding, but not limited to, the following: electric, telephone, gas, water, <br />sewer, surface water control structures and ditches, within the vacated <br />right of way, unless such rights are released by the individual Utilities. <br />"The following property may be injuriously or beneficially affected <br />by such vacation: <br />Lots 1 to 11 both included in Miller Green's 1st Addition <br />to Lowell. <br />Lots 25 and lots 43 to 48 both included and lots 91 to <br />96 both included in Original Plat of Lowell <br />"Notice of this Resolution shall be published on the llth day of February, <br />1972, and the 18th day of February, 1972 in the South Bend Tribune and the Tri <br />County News. <br />"This Board, at its office, on the 22nd day of February, 1972 at 9:30 <br />A.M., will hear and receive remonstrances from all persons interested in or <br />affected by these proceedings. <br />"Adopted this 7th day of February, 1972. <br />BOARD OF PUBLIC WORKS AND SAFETY <br />Charles A.
