6 0' <br />8/16/71. <br />ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3322 - UNIVERSITY OF NOTRE <br />DAME AND STANLEY PIETZAK <br />Lloyd S. Taylor, City Engineer, files assessment roll in Vacation Resolution <br />No. 3322, for the vacation of a portion of Ivy Road running north from the <br />north right of way line of South Bend Avenue to the south right of way line <br />of Edison Road. <br />The following property may be injuriously or beneficially affected by such <br />vacation: Lots 1 to 6 inclusive, and Lots 31 to 36 inclusive, in the town <br />of Shroederville; also Lots 30 to 47 inclusive, in Wooded Estates Addition; <br />also a parcel of land in Section 6, Township 37 north, Range 3 east, bounded <br />on the north by Edison Road, on the south by South Bend Avenue and on the <br />west by the west line of Twyckenham Drive extended north from South Bend <br />Avenue to Edison Road. <br />Benefits and damages: The petitioner will be benefited to the extent of <br />acgamring 18,901.4 square feet of vacated Ivy Road, thereby making their <br />plat a contiguous single parcel. The petitioner, in acknowledgment of the <br />above benefit,has dedicated :an extension of,Twyckenham Drive from South <br />Bend Avenue to Edison Road consisting of 49,053.8 square feet. The <br />petitioner hereby agrees to install concrete curbing on both sides of, the <br />extended Twyckenham Drive. The City of South Bend, Indiana , agrees to the <br />paving of the extended Twyckenham Drive with not less than seven inches of <br />hot asphaltic concrete. The result of the above described negotiations is <br />an equal benefit to the City of South Bend and to the petitioner. There- <br />fore, the benefits and damages are equal resulting in $00.00 difference. <br />Upon motion made, seconded and carried, the Board adopted said assessment roll <br />and set 9:30 A.M. on September 13, 1971, as the time for hearing all persons <br />interested in or affected by said vacation. And the Clerk was'directed to <br />give notice by publication in the South Bend Tribune and the Tri County News <br />on August 20, 1971, August 27 and September 3, 1971. <br />SEWER CONSTRUCTION CONTRACT EXECUTED - GREEN LAND DEVELOPMENT CORPORATION <br />Lloyd S. Taylor moved that the Board of"Public Works and Safety enter into a <br />contract,for the construction of a sewer with the Greenland Development Corpora- <br />tion. The motion was seconded and carried, and the contract executed. <br />REQUEST TO SELL NEWSPAPERS ON PUBLIC SIDEWALKS - KIWANIS CLUB <br />Upon motion made, seconded and unanimously carried, permission was granted to <br />the Kiwanis Club of South Bend, 213 N. Main Street, South Bend, Indiana, to <br />sell newspapers on the public sidewalks in various areas of the City on <br />September 11, 1971, for its charitable project. <br />BENDIX CORPORATION - MOBILE UNITS <br />Upon motion made, seconded and unanimously carried, permission was granted to <br />Bendix Corporation, 401 Bendix Drive, South Bend, Indiana, to continue its use <br />of two mobile units and to add a third mobile unit, at 1217 S. Walnut Street <br />for a period of time not exceeding December 31, 1973. <br />STREET LIGHTING APPROVED - SOUTHEAST ESTATES SECTION 2 <br />Upon motion made, seconded and unanimously carried., the Board approved the <br />recommendation of the Traffic Engineering Department for the installation of <br />7000 MV Traditionaire U.G. fixtures in Southeast Estates, Section 2, at the <br />property line between Lots 47 and 48, between Lots 44 and 45 and between Lots <br />55 and 56, at a cost of $234.00 per year. <br />CONTRACTOR'S BOND TERMINATED - TONY MILLER CONSTRUCTION COMPANY <br />Upon motion made, seconded and carried, the request of Reliance Insurance <br />Company, 333 N. Pennsylvania Street, Indianapolis, Indiana, for termination of <br />its Bond No. B 44 82 58 on behalf of Tony Miller Construction Company was <br />approved for all work done on and after September 4, 1971. <br />
