d_ 1 7 <br />REGULAR MEETING <br />NOVEMBER 26, 1973 <br />A regular meeting of the Board of Public Works was convened at 9:30 a.m, on <br />Monday,.November 26, 1973 with all members present. City Attorney James A. <br />Roemer was also present. Minutes of the previous meeting were reviewed and <br />approved. <br />HEARING ON VACATION RESOLUTION NO. 3387, 1973 <br />This being the date set_,,'hearing was held on Vacation Resolution No. 3387, 1973 <br />for the vacation of the east -west alley between Hill Street and St. Louis Avenue <br />from the east right-of-way line of Hill Street to the west right-of-way line of <br />the north -south alley between Colfax and Washington Streets, situated between <br />Lots 147 and 148 as shown on the recorded plat of the Town of Lowell, not part of <br />the City of South Bend. The Clerk tendered proofs of publication of notice in the <br />South Bend Tribune and in the Tri-County News on November 2 and November 9, 1973. <br />Mr. F. Gerard Feeney, Attorney for the petitioner Northern Electric Company, and <br />Joseph Dosmann were present. Mr. Feeney explained to the Board that all the property <br />owners affected have joined Northern Electric in this petition to vacate the alley. <br />He then presented to the Board a statement, signed by these property owners, supporting <br />the request to vacate. Mr. Feeney said the residents are hoping to eliminate through <br />Q traffic and speeding in the alley. <br />Q No remonstrators appeared and no written remonstrances having been filed, upon <br />motion made, seconded and carried, the Board ratified and confirmed Vacation Resolution <br />No. 3387, 1973 and said alley is vacated. <br />The City Engineer is directed to prepare an assessment roll showing the award of <br />damages and the assessment of benefits to the surrounding properties. <br />HEARING ON VACATION RESOLUTION NO. 3388P 1973 <br />This being the date set, hearing was held on Vacation Resolution No. 3388, 1973 <br />for the vacation of the northwest -southeast alley between George Avenue and Marietta <br />Street north of the Cooper Bridge right-of-way from the bridge northwest to the <br />south right-of-way line of the first southwest -northeast alley between Lots 14 and <br />14 of Frantz 2nd Addition and Lot 13 of Frantz 3rd Addition, City of South Bend. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune and the <br />Tri-County News on the 2nd and 9th day of November, 1973. <br />Mr. William E. Voor, Sr., Attorney for the petitioner Roland Goheen, was present <br />and explained to the Board that this alley is on the right-of-way of the new Cooper <br />Bridge and is not used. The petitioner is going to request a zoning change for the <br />property and plans to erect a billboard. <br />Mr. Isaiah Steed, owner of Lot 12, was present and told the Board that his lot is <br />adjacent to the alley. He said he does use the alley in question and would like it <br />to remain open. He said there are accessory structures on Lots 13 and 14 and the <br />alley should remain open for emergency vehicles. Mr. Voor displayed a map to the <br />Board indicating that the alley can only be used by crossing the State Highway <br />right-of-way. It was the feeling of the Board that a visual inspection of the area <br />should be made before any decision is made. Upon motion made, seconded and carried, <br />the matter was tabled until December 3, 1973. Mrs. Glenda Rae Hernandez, 706 E. <br />South Street, presented a petition to the Board opposing the vacation. Mrs. Hernandez <br />said the petitioners were concerned about further deterioration of the neighborhood. <br />Mr. Voor said the idea behind the vacation of the alley was to clean up the area. <br />REPORT ON VERNON STREET CROSSING <br />The Board received a report from Clem Hazinski, Manager of the Bureau of Traffic <br />and Lighting, regarding a complaint about the condition of the Penn Central Railroad <br />crossing at Vernon Street. Mr. Hazinski attached a copy of a letter written to the <br />Track Superintendent in Elkhart advising him of this problem and requesting that <br />repairs be made. Mr. Farrand said that the Division of Engineering will follow up <br />on this matter to see that the repairs are completed. Upon motion made, seconded <br />and carried,the report was ordered filed. <br />
