676 <br />REGULAR MEETING <br />OCTOBER 8, 1973 <br />Upon motion made, seconded and carfied, the following resolution was adopted: <br />VACATION RESOLUTION NO. 3385_,�1973 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That <br />it is desirable to vacate the follow$ng: <br />Kerr Street beginning at the west right-of-way line of -Catalpa Street and the <br />north right-of-way line of Kerr Street, thence west to the western end of'Kerr <br />Street; thence 59' south to the south right-of-way of Kerr Street; thence east <br />to a point 50' south of point of beginning; thence 50' north to the point of <br />beginning. <br />Reserving the rights and easements of all Utilities and the Municipal City of <br />South Bend, Indiana to construct and maintain any facilities, including, but <br />not limited to, the following: electric, telephone, gas, water, sewer, surface <br />water control structures and ditches, within the vacated right of way, unless <br />such rights are released by the individual Utilities. <br />The following property may be injuriously or beneficially affected by such <br />vacation: <br />Part of the West 2 of the N.E. �, Sec. 14, T37N, R2E, beginning at the inter- <br />section of the South line of Sample Street with the West line of Catalpa, thence <br />West 200 feet, thence South 298.9 feet, thence East 220 feet, thence North 298.9 <br />feet. <br />Also, part of the West I of the N.E. 71T and the East 2 of the N.W. '-4i Sec. 14, <br />T37N, R2E, beginning on the South line of Sample Street 220 feet West of the West <br />line of Catalpa Street, thence South 591.692 feet, thence West 261.512 Feet, <br />thence North 591.692 feet, thence East 361.512 feet. <br />Also, Parcel No. 5 and the West i of the alley lying East of and adjacent to <br />Parcel 5 between Garst and Kerr Streets in the Innerbelt Industrial Park. <br />Notice of this Resolution shall be published on the 12th and 19th day of <br />October, 1973 in the South Bend Tribune and the Tri-County News. <br />This Board, at its office, on the 5th day of November, 1973, at 9:30 o'clock, <br />A.M., will hear and receive remonstrances from all persons interested in or <br />affected by these proceedings. <br />Adopted this 8th day of October, 1973. <br />BOARD OF PUBLIC WORKS <br />s/ Rollin E. Seitz <br />Attest: <br />s/ Patricia DeClercq, Clerk <br />AGREEMENT OF EASEMENT - RIVERSIDE COURT CONDOMINIUMS <br />The Board received an Agreement of Easement between Riverview Homes, Inc, and <br />the City of South Bend to allow for the construction of water mains. Upon motion <br />made, seconded and carried, the Board approved the easement agreement. <br />AWARDING OF BIDS - POLICE DEPARTMENT UNIFORMS <br />The Board received a recommendation from Chief Robert Urban that the uniform bid <br />received from the Gerber Manufacturing Company be accepted. Upon mot$on made, <br />seconded and carried, the Board awarded the bid to Gerber's. <br />PROPOSAL FROM STANDARD OIL COMPANY <br />The Board received a letter from Standard Oil Company proposing to allocate the <br />amount of diesel fuel to be supplied to the City for the balance of the year by <br />reducing it by the amount of furnace oil purchased. Upon motion made, seconded <br />and carried, the Board referred the letter to Stanley M. Przybylinski, Manager, <br />Municipal Services Facility, and to James A. Roemer, City Attorney, for review <br />and recommendation. <br />
