REGULAR MEETING <br />AUGUST 20, 1973 <br />PETITION TO VACATE ALLEY - E/W ALLEY SOUTH OF COLFAX, BETWEEN HILL AND ST. LOUIS <br />Northern Electric Company, by their Attorney F. Gerard Feeney, petitions the Board <br />of Public Works to vacate the east -west alley between Hill Street and St. Louis <br />Avenue from the east right-of-way line of Hill Street to the west right-of-way line <br />of the north -south alley between Colfax and Washington Streets situated between <br />Lots 147 and 148 as shown on the recorded original plat of the Town of Lowell, <br />now part of the City of South Bend, as recorded in Plat Book 1, page 63. <br />Mr. Feeney was present and explained to the Board that the Northern Electric <br />Company owns the property along the alley and they are joined in this petition by <br />the property owners behind them. The alley is being used by people who drive in <br />and park after dark and the petitioners hope to eliminate this by vacating the <br />alley and constructing a fence. <br />Upon motion made, seconded and carried, the Board referred the petition to the <br />Bureau of Engineering for preliminary investigation and recommendation. <br />REQUEST FOR PAYMENT OF ARCHITECTS FEES FOR CIVIC CENTER <br />Mr. Kent Wilcox, Department of Redevelopment, presented to the Board claims for <br />Architects Fees for the Civic Center. The claims were in the amounts of $1,636.80, <br />$561.19 and $927.48 and were for travel expenses and architects programming and <br />pre -schematic services. Upon motion made, seconded and carried, the Board approved <br />and signed the claims. <br />_REQUEST TO ENTER INTO A LEASE WITH THE DEPARTMENT OF REDEVELOPMENT <br />Mr. Kent Wilcox, Department of Redevelopment, asked for Board approval to enter <br />into a lease between the City of South Bend and the Department of Redevelopment <br />for a surface parking.lot on a 20 acre parcel of land on the river where the <br />Redevelopment Site Office has been. The lease would be on a month to month basis. <br />Upon motion made, seconded and carried, the Board authorized the Department of <br />Redevelopment to draw up a lease for the parking lot to be submitted to the Board <br />for signature, subject to approval by the Legal Department. <br />AMENDMENT TO PANEL -AD AGREEMENT <br />The following amendment to the Panel -Ad Agreement was, upon motion made, seconded <br />and carried, approved and signed by the Board and by Mrs. Mardella Hensler, Franchise <br />Holder: <br />AMENDMENT <br />AMENDMENT TO AGREEMENT ENTERED INTO THE 27TH DAY <br />OF MAY, 1968, BY AND BETWEEN THE CITY OF SOUTH <br />BEND THROUGH ITS BOARD OF PUBLIC WORKS AND SAFETY, <br />HEREINAFTER REFERRED TO AS "CITY", AND PANEL ADS, <br />INC., AN OHIO CORPORATION, AND MARDELLA HENSLER, <br />FRANCHISE HOLDER, OF ST. JOSEPH COUNTY, INDIANA, <br />BOTH HEREINAFTER REFERRED TO AS "PANEL AD". <br />Be it moved that Section 5 of the Agreement entered into on the twenty-seventh day <br />of May, 1968, by and between the City of South Bend through its Board of Public <br />Works and Safety and Panel Ads, lnc., read as follows: <br />5. It i,s also agreed and understood that the receptacles will <br />bear advertising panels; that Panel Ad will solicit adver- <br />tising for display on these panels; that all advertising <br />will receive prior approval from the Board of Public Works; <br />-that all other responsibility for such advertising program <br />shall be borne by Panel Ad and that Panel Ad shall receive <br />all benefits derived from such advertising program._ All <br />advertising shall be in good taste, and shall not include <br />liquor ads nor abortion ads. <br />
