REGULAR MEETING.. <br />AUGUST 13, 1973 <br />matters. Mr. Farrand requested that Mrs. Hensler be present at the Board of <br />Public Works meeting on Monday, August 13th. She will be requested to <br />indicate her oral approval to an amendment.reflecting the above agreements. <br />If she refuses to comply with this request, it will be necessary for the <br />City to send a sixty day notice of termination to terminate her contract <br />with the City. <br />Her present contract, though initiated in 1968, does continue automatically <br />on a year-to-year basis unless terminated on a sixty day notice. <br />Mrs. Hensler indicated that she can eliminate the abortion ads from all <br />receptacles at the end of the current month of August. <br />The above amendment will., therefore, eliminate the abortion ad issue without <br />requiring a legal battle. The elimination of the sixty day termination <br />notice will permit the City to terminate the contract immediately if problems <br />arise, and if another source is obtained for this same type of business, on <br />terms more advantageous to the City. <br />s% James A. Roemer <br />Mrs. Hensler was present at the meeting and said that the Panel -Ad agreement had <br />been in effect for five years and this was the first time there had been a problem. <br />She said that all abortion advertisements will be removed by the end of August, <br />and she will accept no more controversial advertising matter. There was a discussion <br />about eliminating the sixty day termination notice in the contract and Mr. Seitz <br />expressed the opinion that it might be beneficial to the City to.leave the cl:euse <br />in the contract. It was moved, seconded and carried, that the City Attorney be <br />instructed to draft an amendment to the contract amplifying the good taste cause, <br />specifically prohibiting abortion ads, and stipulating that all advertising accepted <br />in the future will be subject to prior approval by the Board of Public Works. <br />RECOMMENDATION RE: VACATION OF ALLEY WEST OF NOTRE DAME AVENUE, BETWEEN COLFAX <br />AND WASHINGTON <br />The Board received a recommendation from the Bureau of Engineering that they had <br />reviewed the petition to vacate the alley west of Notre Dame Avenue, between <br />Colfax and Washington, and had no objection to the vacation. Upon motion made, <br />seconded and carried, the Board referred the petition to the Area Plan Commission <br />for investigation and recommendation. <br />RECOMMENDATION RE: VACATION OF ALLEY -WEST OF GEORGE AVENUE NORTH OF COOPER BRIDGE <br />The Board received a recommendation from the Bureau of Engineering stating that they <br />had reviewed the petition to vacate the alley West of George Avenue, North of the <br />Cooper Bridge and have no objection to the vacation. Upon motion made, seconded <br />and carried, the Board referred the petition to the Area Plan Commission for investigation <br />and recommendation. <br />RECOMMENDATION RE: VACATION`OF ALLEY BETWEEN ST. LOUIS AND ST. PETER STREET AND <br />ALLEY BETWEEN ST.-PETER AND NOTR€ DAME <br />The Board received a recommendation from the Bureau of Engineering stating that they <br />had reviewed the petition to vacate the alley between St. Louis and St. Peter Street <br />and the alley between St. Peter Street and Notre Dame and have no objection to the <br />vacation. Upon motion made, seconded and carried, the Board referred the petition <br />to the Area Plan Commission for their investigation and recommendation. <br />APPLICATION FOR CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR THE OPERATION <br />OF TAXICABS <br />The Board received an Application for a Certificate of Public Convenience and <br />Necessity for operation of taxicabs from Rev. Theodore McNeil, 3211 Revere Place, <br />South Bend, Indiana. Mr. Roemer was asked to review the application. Upon Mr. <br />Roemer's request, it was moved, seconded and carried that the application be _ <br />referred to Clem Hazinski, Bureau of Traffic and Lighting for his investigation <br />
