<br />JULY 30, 1973
<br />A regular meeting of the Board of Public Works convened at 9:30 a.m, on Monday,
<br />July 30, 1973 with all members present. Minutes of the last meeting were
<br />reviewed and approved.
<br />HEARING ON VACATION RESOLUTION NO. 3380, 1973
<br />This being the date set, hearing was held on Vacation Resolution No. 3380,
<br />1973, for the vacation of the North -South alley between Sunnyside Avenue
<br />and Twyckenham Avenue from the south right of way line of East Wayne Street
<br />south to the north right of way line of the East-West alley between East
<br />Wayne Street south and Sunnymede Avenue situated between Lots 164 and 165
<br />in Sunnymede 1st Addition. The Clerk tendered proofs of publication of
<br />notice in the South Bend Tribune and the Tri-County News on July 6 and July
<br />13, 1973.
<br />Charles A. Sweeney, Jr., Attorney representing the petitioner Jerome B.
<br />Kearns, spoke before the Board. Mr. Sweeney said the petition was originated
<br />because the Kearns have small children and the alley generates traffic which
<br />is a hazard to them. Noise is a problem as the alley is used at night by
<br />teen agers as a "merry-go-round", and there is drinking which results in empty
<br />bottles being discarded in the alley. Mr. Sweeney pointed out -that two alleys
<br />in the immediate area have been previously vacated. Mr. & Mrs. Kearns, 1344
<br />E. Wayne St. and Mrs. Robert Hamilton, 1340 E. Wayne Street, then spoke in
<br />favor of the vacation.
<br />Mrs. Gust Ninios, 1315 Sunnymede, spoke against the vacation and expressed
<br />her concern that trash trucks would not be able to get through the,alley
<br />which will remain open for pick-ups. She said she is opposed to residents
<br />putting their trash in front of their homes for pick-up. Mr. Russell Fisher,
<br />Attorney representing Mr.,& Mrs. Van Schrom, 1351 Sunnymede Avenue, spoke
<br />opposing the vacation. He said the Schrom's chief objection was that closing
<br />the alley could cause a problem with trash removal. Mr. Peter D. Pook, 1339
<br />Sunnymede Avenue, Mr. Don Horning, 1324 E. Wayne St. S., and Mr. Karl Kron-
<br />stein, 1328 E. Wayne St. S., spoke in opposition to the vacation on the
<br />grounds that it would hamber trash pick-up.
<br />Mr. Sweeney presented to the Board a letter from Mrs. Mabel Klinger, 1348 E.
<br />Wayne St., who could not be present at the hearing but expressed her approval
<br />of the proposed vacation.
<br />Upon motion made by Mr. Barcome and seconded by Mr. Seitz and carried (with
<br />Mr; Farrand abstaining), the Board ratified and confirmed Vacation Resolution
<br />No. 3380, 1973 and said alley is_vaeated.
<br />The City Engineer is directed to prepare an assessment roll showing the
<br />award of damages and the assessment of benefits to the surrounding properties.
<br />REQUEST FROM SCOTTSDALE MALL FOR FIREWORKS DISPLAY
<br />The Board received a request from Carl Esser, Manager of the Scottsdale Mall,
<br />for permission to set off a display of aerial bombs in -connection with the
<br />Grand Opening of the Mall on August 1, 1973 at 10:00 a.m. Upon motion made,
<br />seconded and carried, the Board approved the request subject to the posting
<br />of a bond in the amount of $20,000 to hold the City harmless and the presenting
<br />of written approval, in the form of a permit, from the State Fire Marshall.
<br />NOTICE OF SALE OF CITY -OWNED REAL ESTATE
<br />Three parcels of real estate owned by the City were previously advertised for
<br />sale and no bids were received. Upon motion made, seconded and carried, the
<br />Board directed that the following parcels of real estate by advertised for
<br />sale on August 3 and August 10 with bids to be received on August 27, 1973:
<br />Lot No. 7 (Portion of this lot) on Recorded Plat of Hickey's Sub.
<br />of Lot Numbered 150 in Sorin's 2nd Addition to the Town of Lowell,
<br />now a part of the City of South Bend, commonly known as 917 N. Hill
<br />Street. Offering Price - $1,310.00.
