REGULAR MEETING APRIL 30, 1973 <br />ADOPTION OF VACATION RESOLUTION NO. 3377, 1973 <br />VACATION RESOLUTION NO. 3377, 1973 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS,OF THE CITY,OF SOUTH BEND, INDIANA, <br />That it is desirable to vacate the following: <br />Alley running south from Madison Street to the first East-West alley <br />between St. Peter and Notre Dame Avenue. <br />Reserving the rights and easements of all Utilities and the Municipal <br />City of South Bend, Indiana, to construct and maintain any facilities, including, <br />but not limited to, the following: electric, telephone, gas, wqter, sewer, <br />surface water control structures and ditches, within the vacated right of way, <br />unless such rights are released by the individual Utilities. <br />The following property maybe injuriously or beneficially affected by such <br />vacation: Lots 276, 277, 278, 282, 283 and 284 in Samuel Cottrell's First <br />Addition to Lowell. <br />Notice of this Resolution shall be published on the 4th and the llth day <br />of May, 1973 in the South Bend Tribune and in the Tri-County News. <br />This Board, at its office, on the 29th day of May, 1973 at 10:45 o'clock A.M. <br />will hear and receive remonstrances from all persons interested in or affected by <br />these proceedings. <br />Adopted this 30th day of April, 1973. <br />BOARD OF PUBLIC WORKS <br />s/ William J. NORTH OF WESTERN AVENUE <br />The Board received a recommendation from Mr. James Roemer that a proposal to <br />vacate the alley North of Western Avenue, between Scott and Taylor Streets, which <br />was presented to the Board some time ago, should now be initiated by the City. <br />Upon motion made, seconded and carried, the petition was referred to the Area Plan <br />Commission for their study and recommendation. <br />AGREEMENT AND ENGINEER ASSIGNMENT FOR PROJECT T6000 (11) - TOPICS <br />Upon motion made, seconded and carried, the Board signed an Engineer Assignment <br />Letter and an Agreement with the Indiana State Highway Commission for the Topics <br />Project 6000 (11) Signalization-of Michigan Street from Chippewa Avenue to South <br />Street and Main Street from Chippewa Avenue to Sample Street. <br />COMPLAINT - TED CARLSON, SR. -.FENCE ACROSS ALLEY <br />Ted Carlson, Sr., 119 N. Notre Dame Avenue, appeared before the Board to complain <br />about a chain fence which has been put across an alley running from the 100 block <br />of Notre Dame Avenue to the north -south alley between Colfax and Washington. <br />This fence is blocking property owners access to the alley. Upon motion made, <br />seconded and carried, the Board referred the matter to the City Attorney to <br />initiate immeaiate legal action against the property owner who installed the fence, <br />to make sure that the fence is removed and access restored to the alley. <br />1 <br />1 <br />L <br />
