REGULAR MEETING APRIL 30, 1973 ADOPTION OF VACATION RESOLUTION NO. 3377, 1973 VACATION RESOLUTION NO. 3377, 1973 RESOLVED BY THE BOARD OF PUBLIC WORKS,OF THE CITY,OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: Alley running south from Madison Street to the first East-West alley between St. Peter and Notre Dame Avenue. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, wqter, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property maybe injuriously or beneficially affected by such vacation: Lots 276, 277, 278, 282, 283 and 284 in Samuel Cottrell's First Addition to Lowell. Notice of this Resolution shall be published on the 4th and the llth day of May, 1973 in the South Bend Tribune and in the Tri-County News. This Board, at its office, on the 29th day of May, 1973 at 10:45 o'clock A.M. will hear and receive remonstrances from all persons interested in or affected by these proceedings. Barcome ATTEST: s/ Patricia DeClercq, Clerk Upon motion made, seconded and carried, the Vacation Resolution was adopted. PETITION TO VACATE ALLEY - BETWEEN TAYLOR AND SCOTT. NORTH OF WESTERN AVENUE The Board received a recommendation from Mr. James Roemer that a proposal to vacate the alley North of Western Avenue, between Scott and Taylor Streets, which was presented to the Board some time ago, should now be initiated by the City. Upon motion made, seconded and carried, the petition was referred to the Area Plan Commission for their study and recommendation. AGREEMENT AND ENGINEER ASSIGNMENT FOR PROJECT T6000 (11) - TOPICS Upon motion made, seconded and carried, the Board signed an Engineer Assignment Letter and an Agreement with the Indiana State Highway Commission for the Topics Project 6000 (11) Signalization-of Michigan Street from Chippewa Avenue to South Street and Main Street from Chippewa Avenue to Sample Street. COMPLAINT - TED CARLSON, SR. -.FENCE ACROSS ALLEY Ted Carlson, Sr., 119 N. Notre Dame Avenue, appeared before the Board to complain about a chain fence which has been put across an alley running from the 100 block of Notre Dame Avenue to the north -south alley between Colfax and Washington. This fence is blocking property owners access to the alley. Upon motion made, seconded and carried, the Board referred the matter to the City Attorney to initiate immeaiate legal action against the property owner who installed the fence, to make sure that the fence is removed and access restored to the alley. 1 1 L
