1/15/73 <br />January 10, 1972 <br />Board of Public Works and Safety <br />County -City Building <br />South Bend, Indiana 46601 <br />Re: Alley located on Western Avenue, between Taylor and Scott <br />Streets, separating Lots 185-3f 1846, 1848, 1857 and 1858 <br />from Lots 1854, 1855 and 1856. The alley begins 115.1 <br />feet west of Taylor Street, then runs north 112 feet, west <br />106 feet, and south 112 feet (inside measurements) <br />Gentlemen: <br />In the opinion of Saint Patrick's Parish Council, there is no need for this <br />alley: <br />1. It has not been used for many .years. . <br />2. It divides two portions of Saint Patrick's Parish property (Lots <br />1853 and 1854) and separates portion of our own lots 1846 and <br />1854 from each other. <br />3. Two of the lots, bordering on the, alley, not owned by Saint <br />Patrick's (1855 and 1856) have been neglected for more than ten <br />years. The Park Department has cooperated in destroying the growth <br />of marijuana on that portion of the block. <br />4. It is our judgment that the community of our area does not benefit <br />from the existence of this alley. <br />With these items in mind, we suggest that your board initiate action and take <br />steps to the vacating of this alley. <br />Respectfully submitted for Saint <br />Patrick's Parish Council <br />/s/ Richard J. Kennedy, C.S.C. <br />RJK/p <br />Upon motion made, seconded and carried, the letter was referred to the Bureau <br />of Engineering for their report. <br />PAYMENT REQUEST - WASTE WATER TREATMENT PLANT ADDITIONS <br />Upon motion made, seconded and carried, the Board approved a payment request <br />invoice to Sollitt Construction Company, Inc. in the amount of $97,359.56 <br />for additions to the Waste Water Treatment Plant. <br />HEARING ON MOTION FOR SUMMARY JUDGMENT - CAUSE NO. F3792 <br />Mr. Sweeney informed the Board that the hearing date for Cause No. F3796, <br />James P. Creech vs. the Board of Public Works and Safety and the William Penn <br />Fraternal Association is January 18, 1973 at 11:00 a.m. and that the Legal <br />Department has been apprised of this and will represent the Board. <br />REQUEST FROM COUNTY POLICE DEPARTMENT FOR THREE PARKING SPACES <br />A request from Sheriff Dean Bolerjack for parking spaces on Main Street for <br />police and court business was continued until this date. Upon motion made, <br />seconded and carried the Board referred this matter to Mr. Stanley Hull, Manager <br />of the Municipal Parking Garages, with the request that he report to the Board <br />on the disposition of vacant property immediately across the street from the <br />Court House to see if something can be worked out to lease this property <br />from the Department of Redevelopment for a surface parking lot. <br />RELEASE OF BONDS - MIDLAND ENGINEERING COMPANY, INC. - <br />Upon motion made, seconded and carried, the Board released Contractor's, <br />Excavation, and Occupancy Bonds, Nos. B 27, 56 57, B 27, 56 65 and B 44 <br />84 59 carried by the Reliance Insurance Company on Midland Engineering <br />Company, Inc..for all work done after January 1, 1973. <br />
