10/23/72 <br />1 <br />After discussion of the matter it was the decision of the Board was <br />that once the Board has jurisdiction in the matter it is too late <br />for privately -hired work, and the_contvact with O'Neal Trucking <br />Company was declared valid. <br />Lot 44 Wenger Street This being the date set -for receiving bids <br />for the demolition of a structure on Lot=: 44 on Wenger Street <br />the following bids were opened and read after ascertaining that <br />non -collusion affidavits were in proper order: <br />Michiana Builders $225.00 <br />O'Neal Trucking Company 150.00 <br />Upon motion made, seconded and carried, the award was made to <br />the O'Neal Trucking Company on its low bid of $150.00.. <br />105 North Carlisle Street Upon the recommendation of Mr. Steed, <br />the matter of the sub -standard condition of the structure at <br />105 North Carlisle Street was continued for one week, <br />HEARING ON VACATION RESOLUTION NO. 3369,1.972 - ROSE STREET <br />This being the date set, hearing was had on Vacation Resolution No. <br />3369,1972 for the vacation of certain alleys and a portion of Rose <br />Street and Cushing Street. <br />The Clerk tendered proofs of publication of notice in the South <br />Bend Tribune and the Tri County News on the 13th day of October <br />and the 20th day of October, 1972 and same were found to be sufficient. <br />No remonstrators having appeared and no written remonstrances <br />having been filed, upon motion made, seconded and carried, the said <br />Resolution adopted on October IOth, 1972 is ratified and confirmed <br />and said streets and alleys closed. <br />The City Engineer is now directed to prepare an assessment roll <br />showing the award of damages and the assessment of benefits to the <br />surrounding properties. <br />AREA PLAN RECOMMENDATION FOR THE VACATION OF MERRY AVENUE AND ALLEYS <br />REDEVELOPMENT <br />Area Plan Commission now files with the Board its favorable recommend- <br />ation for the vacation of the alleys and Merry Avenue in the Merry <br />Avenue Project. The City Engineer is now requested to prepare a <br />Vacation Resolution. <br />AREA PLAN COMMISSION RECOMMENDATION FOR VACATION OF DEAN STREET <br />Area Plan Commission now files with the Board its favorable recommend- <br />ation for the vacation of a portion of Dean Street. The City Engineer <br />informed the Board this area was adjacent to some water works property. <br />Upon motion made, seconded and carried, the vacation is referred to <br />the Bureau of Engineering for study and report. <br />AREA PLAN COMMISSION RECOMMENDATION ON VACATION OF ALLEY BETWEEN NILES <br />AVENUE AND HILL STREET <br />Area Plan Commission now informs the Board that the petition of <br />Marguerite P. Luter to vacate the alley between Niles Avenue and Hill <br />Street has been withdrawn. Upon motion made, seconded and carried <br />the Board now withdraws the petition to vacate. <br />REQUEST OF MUSCULAR DYSTROPHY ASSOCIATION <br />A letter was received from the Muscular Dystrophy Associations of <br />America, Inc., requesting permisstion to hold their annual drive for <br />funds on November 12, 1972. Also that the various Fire Department <br />Stations act as collection points for kits that are turned in. Upon <br />motion made, seconded and carried, the request was granted pending <br />the approval of the Charitable Solicitations Committee. <br />
