REGULAR MEETING <br />JUNE 16, 1975 <br />ADOPTION OF RESOLUTION NO. 19,V1975 - RE: SEWER ASSESSMENT <br />FOR BURNETT INDUSTRIAL PARK <br />A resolution in agreement with the letter dated June 4, 1975 <br />from George F. Burnett, Inc. and which letter was approved by <br />the Board of Public Works on June 9, 1975 was prepared by the <br />Bureau of Design and Administration and submitted to the Board. <br />Upon motion made, seconded and carried the following resolution <br />was adopted: <br />RESOLUTION N0. 19; 1975 <br />BOARD OF PUBLIC WORKS <br />CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the Board of Public Works has found it in the best interest <br />of the public health and wlefare to construct a sanitary <br />trunk sewer in an area along South Michigan Street to <br />Johnson Road, mostly in Gilmer Park Subdivisions but <br />including other lands, all in Centre Township, St. Joseph <br />County, Indiana, and <br />WHEREAS, the Board of Public Works did establish the construction <br />authority, the location and the necessity for said sanitary <br />trunk sewer by adopting Resolution No. 11-16-70(b), and <br />WHEREAS, the cost of said sewer was paid for out of funds known as <br />Cumulative Sewer Building and Sinking Fund, and not <br />assessed against the property owners, and <br />WHEREAS, the policy of the Board of Public Works is to charge the <br />benefited property at a rate of seven (7) cents per square <br />foot up to 150 feet in depth from the property line, and <br />WHEREAS, George F. Burnett, Inc., an owner of real estate directly <br />benefiting from this sewer and subject to Resolution No. <br />6-14-71 of the Board of Public Works which established a <br />rate of seven (7) cents per square foot up to 150 feet <br />in depth from the property line, and <br />WHEREAS, George F. Burnett Company, Inc. has subdivided the subject <br />real estate and desires that the assessment applicable to <br />the total area be prorated on a gross area basis to the <br />individual lots or parcels in the subdivision, and <br />WHEREAS, as a consideration for granting an easement to the City of <br />South Bend, Indiana, an existing building situated on -what <br />is now considered Lot number 1 was excluded from any <br />assessment, said easement being recorded in Book 75, pages <br />87-80 in the St. Joseph County Recorders Office, <br />NOW, THEREFORE, BE IT RESOLVED, that the fee for connection to any <br />sewer in the Burnett Industrial Park shall be according to <br />the following schedule of fess for the lots depicted on an <br />approved preliminary plat filed in the office of the St. <br />Joseph County, Indiana Area Plan Commission: <br />Lot No. <br />1 -0- <br />2 -0- <br />3 -0- <br />4 $3,502.45 <br />5 4,578.70 <br />
