312 <br />REGULAR MEETING MARCH 10, 1975 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m, on Monday, March 10, 1975 with Mr. Farrand and Mr. Barcome <br />present. Deputy City Attorney Kathleen Cekanski was also present. <br />Minutes of the previous meeting were reviewed and approved. <br />OPENING OF BIDS - FIRE STATION NO. 11 OFFERED FOR SALE <br />This was the date set for receiving bids for the dale of Fire Station <br />No. 11. The Clerk tendered proofs of publication of notice in.the <br />South Bend Tribune and the Tri-County News which were found to be <br />sufficient. <br />There were no bids received. <br />PUBLIC HEARING - VACATION RESOLUTION 140. 3411, 1975 <br />This being the date set hearing was held on Vacation Resolution No. <br />3411, 1975 for the vacation of the north -south alley between Taylor <br />Street and William Street running north from Monroe Street to the <br />first east -west alley as found on the recorded plat of William E. <br />Vail's Southwest Addition to the Town, now City of South Bend. The <br />Clerk tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri-County News which were found to be sufficient. <br />Mr. William Mclnerny, Attorney for the petitioner Gates Realty, Inc., <br />and Van E. Gates were present. Mr. Mclnerny displayed a drawing of <br />the proposed vacated area to the Board. He noted that the Area Plan <br />Commission recommended this vacation favorably, subject to the providing <br />for turning east and west off this part of the alley. 17r.Mclnerny <br />said this matter has been discussed with the Traffic Engineer and they <br />are willing to provide the land nneded for a maximum turning radius <br />of 42 feet. Mr. Mclnerny said the petitioner has done a good job of <br />cleaning up the area. They own all but one of the lots involved. <br />Several sub -standard buildings in the area have been removed. Mr. <br />Gates then spoke to the Board and said that this situation came about <br />because his employees were parking on the street and this is an effort <br />to eliminate the problem of all day parking on the streets by providing <br />a parking lot. Mr. Gates said he feels they have benefited the entire <br />neighborhood in the clean-up which has been accomplished. GIs. Sally <br />Woodson, 516 Western Avenue, was present and informed the Board that <br />she was not in favor of the vacation. She said trucks service her <br />business and she felt that closing the alley would create a problem. <br />Ms. Woodson said she was not able to attend the Area Plan Commission <br />hearing on this vacation but she sent them a letter expressing her <br />views. She then questioned the fact that the property vacated would <br />be given to some lot owners. Mr. Farrand explained that, in any <br />confirmed vacation proceeding, the vacated property is awarded to the <br />abutting property owners. Mr. Gates then said he felt they had <br />answered PZs. Woodson's objection in regard to the trucks by agreeing <br />to provide the land needed for turning. Mary Bailey, 504 Taylor Street, <br />was present and asked the Board how the vacation would affect her <br />property. Board members explained to Mrs. Bailey that the alley was <br />being vacated but provision was being made for turns to be made. <br />Upon motion made, seconded and carried, the Board confirmed the Vacation <br />Resolution, subject to the inclusion of provision for the turning <br />movement of trucks as recommended by the Bureau of Traffic and <br />Lighting. The petition was referred to the Division of Engineering <br />for preparation of the Assessment Roll. <br />PUBLIC HEAPING - VACATION RESOLUTION 110. 3412, 1975 <br />This being the date set, hearing was held on Vacation Resolution <br />No. 3412, 1975 for the vacation of the north -south alley between <br />Phillipa and Carlisle Street, from Dunham Street south to the first <br />alley south of Dunham Street, City of South Bend. <br />Mr. Carl Weidler, Attorney for the petitioner was present, as was <br />A. E. Mickelson, the petitioner. Mr. Weidler informed the Board <br />that this petition was recommended favorably by the Area Plan <br />
