REGULAR MEETING <br />JANUARY 6, 1975 <br />CERTIFICATE OF INSURANCE FILED - DILLABAUGH MOVING ENGINEERS <br />A Certificate of Insurance from Dillabaugh Moving Engineers was <br />submitted to the Board. Upon motion made, seconded and carried, the <br />Certificate was ordered filed. <br />NOTICE OF PUBLIC UTILITY USE - VACATION RESOLUTION NO. 3408, 1974 <br />The Board received a Notice of Public Utility Use from the Northern <br />Indiana Public Service Company regarding the vacation of a portion <br />of Colfax Avenue west of Jackson Street and the north -south alley from <br />Washington Street to Colfax Avenue,, City of South Bend. The Notice <br />reserved their easement rights in this area. Upon motion made, <br />seconded and carried, the notice was ordered filed. <br />RESOLUTION ADOPTED - AUTHORIZING SALE OF PROPERTY TO DEPARTMENT OF <br />REDEVELOPMENT <br />A Resolution approving the sale of a parcel.of land to the Department <br />of Redevelopment was submitted to the Board. Miss Cekanski informed <br />the Board that this parcel was part of the parcel of lots to be sold <br />for park use in the southeast neighborhood,.but the City did not have <br />clear title to.it at the time the previous resolution was adopted. <br />She recommended that the Board adopt the resolution. Upon motion made, <br />seconded and carried, the following resolution was adopted: <br />RESOLUTION NO. 1, 1975 <br />RESOLUTION AUTHORIZING THE SALE OF REAL ESTATE <br />TO THE DEPARTMENT OF REDEVELOPMENT OF THE CITY <br />OF SOUTH BEND, INDIANA. <br />WHEREAS, the City of South Bend owns certain real estate as hereinafter <br />described which is not necessary to the public use and is no longer <br />needed and is not set aside by the State of Indiana or the City of <br />South Bend for public purposes; and <br />WHEREAS, appraisal has been made of said real estate by qualified , <br />appraisers and said appraisals are in writing, are now available and <br />are placed of record; <br />WHEREAS., the Department of Redevelopment of the City of South Bend <br />now desires to purchase from the City of South Bend the hereinafter <br />described real estate for a sum equal to the appraised value thereof; and <br />WHEREAS, the Department of Redevelopment of the City of South Bend is a <br />public body co -extensive with the territory of the City of South Bend <br />and is a part of and a Department within the City of South Bend within <br />the purview of I.C. 5-18-1-1, permitting the sale of real estate with <br />another public body co -extensive with the territory of another public <br />body, or which one public body is a part of such other public body upon <br />the terms set forth therein; and such sale is further provided for <br />pursuant to the terms of such statute by Chapter 30A-2 of the Municipal <br />Code of the. City of South Bend. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the <br />City of South Bend, Indiana: <br />1. That the Board now determines that the hereinafter described real <br />estate is not necessary to the public use and is no longer needed <br />and is not set aside by the State of Indiana or the City of South Bend <br />for public purposes; and the valuation of said parcel is hereby <br />established in the amount set forth. <br />PARCEL NO.
