6 pi REGULAR MEETING DECEMBER 30, 1974 A regular meeting of the Board of Public Works was convened at 9:30 a.m. on Monday, December 30, 1974 with all members present. Deputy City Attorney Kathleen Cekanski was also present. Minutes of the previous meeting were reviewed and approved. PUBLIC HEARING - VACATION RESOLUTION NO. 3407, 197.4 -,ST. JOSEPH HOSPITAL This being the date set, hearing was held on Vacation Resolution No. 3407, 1974 for the vacation of the alley between St. Louis and St. Peter Streets, from Madison Street south 198 feet, City of South Bend. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News on December 6 and 13 which were found to be sufficient. Mr. Timothy W. Woods, Attorney for St. Joseph Hospital, the petitioner, was present. There were no remonstrators present and no written remonstrances were filed with the Board. Upon motion made, seconded and carried, the Board ratified and confirmed Vacation Resolution No. 3407, 1974 and said alley is vacated. The City Engineer is directed to prepare an Assessment Roll showing the award of damages and the assessment of benefits to the surrounding properties. PUBLIC HEARING - VACATION RESOLUTION NO. 3408, 1974 - THE O'BRIEN CORPORATION This being the date set, hearing was held on Vacation Resolution No. 3408, 1974 for the vacation of a portion of Colfax Avenue west of Jackson Street and the north -south alley from Washington Street to Colfax Avenue, City of South Bend. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. Mr. Timothy Woods, Attorney for the O'Brien Corporation, the petitioner, was present. Mrs. Joseph Horvath was present and asked the Board about the property at 120 N. Jackson, which belonged to her parents. She asked about an appraisal of the property made recently and whether the City was going to purchase the property. Mr. Farrand directed Mrs. Horvath to David Wells of the Engineering Department in regard to a Model Cities sewer project in the area. Mr. & Mrs. John Borders, 209 N. Jackson Street, were present and asked the Board what effect this hearing would have on their property. It was deter- mined that they are about two blocks from the proposed vacation and would not be affected. Upon motion made, seconded and carried, the Board ratified and confirmed Vacation Resolution No. 3408, 1974 and said portion of Colfax Avenue and the north -south alley is vacated. The City Engineer is directed to prepare an Assessment Roll showing the award of damages and the assessment of benefits to the surrounding properties. REQUEST TO CLOSE NAVARRE STREET ON MAY 2 AND TO ERECT A TENT The Board received a letter -from the Junior League outlining their plans to renovate a house and hold a Show House Project. They are requesting that Navarre Street be closed from Portage to Lafayette on May 2, 1975 in connection with their show and would also like permission to erect a tent from May 2 through May 23. Upon motion made, seconded and carried, the request was referred to the Bureau of Traffic and Lighting and the Building Department for review and recommendation. Mr. Hazinski was directed to take a close look at the request for the closing of Navarre Street with regard to traffic patterns in the area and to contact a representative of the Junior League to work with them on acceptable arrangements. ACCEPTANCE OF TOPICS T6000(6) BY STATE HIGHWAY COMMISSION The Board received a letter from the Indiana State Highway Commission indicating that they have accepted the completed construction under Project T6000(6), the South Michigan Street viaduct project and have released the contractor from further maintenance responsibility. The project now reverts to the City of South Bend for maintenance. Upon motion made, seconded and carried, the letter was filed.
