REGULAR MEETING APRIL 15, 1974 <br />PUBLIC HEARING - IMPROVEMENT RESOLUTION NO. 3400, OAK PARK SEWERS <br />This being the date set., hearing was held on the construction of sanitary sewers <br />on Oak Park Drive and Edison Road from'0ak Ridge Drive to Ironwood Road, <br />authorized by Improvement Resolution No. 3400, 1974, adopted by the Board on <br />April 1, 1974. The Clerk tendered proofs of publication of notice in the <br />South Bend Tribune and the Tri-County News on April 5 and April 12, 1974 <br />which were found to be sufficient. A preliminary assessment roll was available <br />for inspection. <br />No remonstrators were present and no written remonstrances having been received, <br />the Board, upon motion made, seconded and carried, confirmed Improvement <br />Resolution No. 3400, 1974, as adopted, and the improvement is hereby ordered <br />to be made. <br />PUBLIC HEARING - IMPROVEMENT RESOLUTION NO. 3401, OAK PARK WATER MAINS <br />This being the date set, hearing was held on the installation of water mains <br />on Oak Park Drive and Rosemary Lane, authorized under Improvement Resolution <br />No. 34oi, 1974 adopted by the Board on April 1, 1974. The Clerk tendered <br />proofs of publication of notice in the South Bend Tribune and the Tri-County <br />News which were found to be sufficient. A preliminary assessment roll was <br />available for inspection. <br />Gz: <br />No remonstrators were present and no written remonstrances were received. <br />Upon motion made, seconded and carried, the Board took the Improvement <br />Resolution under advisement, awaiting clarification from the Legal Department. <br />RESOLUTION PERMITTING RELOCATION OF SOUTH SHORE TRACKS APPROVED <br />Upon motion made, seconded and carried, the following Resolution was <br />adopted by the Board: <br />RESOLUTION NO. 3, 1974 <br />WHEREAS, the Board of Public Works of the City of South Bend, desires to repave <br />and install new curbs and gutters on the north side of Westmoor Street between <br />Sheridan Avenue and Bendix Drive; and <br />WHEREAS, the Chicago South Shore and South Bend Railroad desires to relocate <br />their railroad tracks from the traveled right-of-way of said street to a right- <br />of-way 21 ft. in width along the north side of said street extending from <br />Sheridan Avenue to Bendix Drive; and <br />WHEREAS, it will be necessary for the Chicago South Shore and South Bend Railroad <br />to reconstruct its track crossings across Sheridan Avenue, Iowa Street and <br />Kentucky Street; <br />NOW, THEREFORE, BE IT RESOLVED that the Board of Public Works of the City of <br />South Bend, hereby grants its written permission to the Chicago South Shore <br />and South Bend. Railroad to construct new track crossings across Sheridan AVenue, <br />Iowa Street and Kentucky Street in the City of South Bend, Indiana as closed <br />track crossings in a right-of-way 21 ft. in width along the north side of <br />Westmoor Street from a point of approximately 200 ft. west of Sheridan Avenue <br />to a point at the intersection of Westmoor Street and Bendix Drive. <br />Adopted this 15th day of April, 1974. <br />BOARD OF PUBLIC WORKS <br />s/ Rollin E. Bar.come <br />ATTEST: <br />s/ Patricia DeClercq, Clerk <br />Mr. Farrand informed the Board that he, Mr. Decker and Mr. Hazinski have been <br />working on this with the South Shore and they feel it is to the City's benefit. <br />The Board resolution and a proposed ordinance granting the right-of-way and <br />ratifying permission to lay railroad tracks across streets will be submitted <br />to the Common Council. <br />
