REGULAR MEETING
<br />MARCH 25, 1974
<br />A.regular-meeting of -the Board -of Public Works was convened at 9:30 a.m. on
<br />Monday, March 25, 1974 with all members present. Deputy City Attorney William
<br />Stanley was also present. Minutes of the previous meeting were reviewed and
<br />approved.
<br />APPROVAL OF CIVIC CENTER CLAIMS
<br />Charles F. Lennon, Jr., Director, Department of Redevelopment, was present and
<br />asked the Board to approve Civic Center claims. The claims have already been
<br />approved by the Civic Center Authority. Claims submitted were as follows:
<br />$31,000, Design Development Phase; $1459.40, Architects Expenses; $310.80,
<br />Architects Programming Services, and $5,812.50 for Landscaping Design Phase.
<br />Upon motion made, seconded and carried, the Board approved the claims.
<br />PUBLIC HEARING - VACATION RESOLUTION NO. 3395, 1974
<br />This being the date set, hearing was held on Vacation Resolution No. 3395, 1974
<br />for the vacation of the north south alley between Carroll and Columbia Streets,
<br />from Bronson Street south One Hundred Thirty-nine (139) feet, City of South
<br />Bend.
<br />The Clerk tendered proofs of publication of notice in the South Bend Tribune
<br />and the Tri-County News on March 1 and March 8, 1974 which were found to be
<br />sufficient.
<br />Mr. James Kuehl, Attorney for the petitioners, Curtis Products, Inc., was
<br />present. Mr. Kuehl said this petition was reactivated and amended to request
<br />that only a portion of the alley be vacated. The original petition received an
<br />unfavorable recommendation from the Area Plan Commission because property owners.
<br />remonstrated against the closing. Curtis Products requested the petition be
<br />amended and reactivated and has dedicated to the City a new 14 foot north -south
<br />alley to allow properties at the end of the alley to have access. The Area
<br />Plan Commission gave this amended petition a favorable recommendation.
<br />Miss Enid Sponholz was present and objected to the vacation. She said she would
<br />like to retain the residences in the area and said she objected to the building
<br />of more industrial plants in the area. She questioned whether the zoning permits
<br />these uses. She said some homes in the area have been torn down for industrial
<br />use. Mr. Farrand said, at his request, a study was made of the zoning in the area
<br />and it is zoned light industrial and present use of the property is consistent with
<br />the zoning classification. Mr. Lloyd Boocher, who operates a body shop across
<br />the street from the proposed vacated alley, was also present to object to the
<br />vacation. Mr. Gene Yundt, Vice President of Curtis Products, Inc., said that Miss
<br />Sponholz rents part of her property to businesses and that Mr. Boocher's operation
<br />involves parking cars on his property. Mr. Yundt said the new alley will provide
<br />more access to these people. Curtis Products will provide space on their lots for
<br />their trucks. Miss Sponholz said trucks might block the new alley. Mr. Farrand
<br />said if this occurred it would be an enforcement problem and she should contact
<br />the City Engineer for appropriate action. Mr. Yundt said the houses torn down
<br />in the area were all sub -standard. Upon motion made, seconded and carried, the
<br />Board accepted the dedication of the new fourteen foot alley, running north and
<br />south, taken off and from the entire length of the South Side of Lot C and
<br />the entire length of the South Side of Lot K of the survey of Lots A, B, C, D, E,
<br />H, I, and K of A. R. Sample's Subdivision of Lots 26, 27 and 28, Denniston's and
<br />Fellows Addition as recorded in Deed Record 2, Page 32 in the Office of the
<br />Recorder of St. Joseph County.
<br />Upon motion made, seeonded and carried, the Board ratified and confirmed
<br />Vacation Resolution No. 3395, 1974 and said alley is vacated. The City
<br />Engineer is directed to prepare an Assessment Roll showing the award of
<br />damages and the assessment of benefits to the surrounding properties.
<br />AGREEMENT WITH IUSB FOR POLICE ACADEMY APPROVED
<br />The Board received copies of an Agreement between the City of South Bend and
<br />I. U. S. B. for use of space for the South Bend Police Academy during the
<br />period of January l through September 30, 1974. Upon motion made, seconded
<br />and carried, the agreement was approved.
