MEETING <br />OCTOBER 111, 1976 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m. on Monday, October 11, 1976 by President Rollin E. <br />Farrand with Mr. Farrand, Mr. Brunner and Mr. Mullen present.. <br />Deputy City Attorney Georgia Luks was also present.. <br />MINUTES OF PREVIOUS MEETING APPROVED <br />Mr. Farrand reported that the minutes of the October 4 meeting of <br />the Board had been reviewed and he made a motion that the minutes <br />be approved as submitted. Mr. Brunner seconded the motion and it <br />carried. Mr. Farrand noted that.a special meeting of the Board was <br />held on October: 8 to,.approve, a request of _ the Mayor's Downtown. <br />Development Committee to use River Bend Plaza to obtain signatures <br />on petitions asking Sears Roebuck & Company to stay in the downtown.. <br />Mr. Farrand said he had reviewed the special meeting minutes and he <br />made a motion that they be approved as submitted. Mr. Mullen seconded <br />the motion and it carried. <br />PUBLIC HEAPING - SANITARY SEWERS IN HIGIILA14D PARK, 2ND ADDITION. <br />This was the date set for holding a hearing on Improvement Resolution <br />No. 3433 for the construction of sanitary sewers in Highland Park, <br />2nd Addition, on Highland Avenue, Hillside Avenue and Phillipa <br />Street, from Ewing Avenue north to Indiana Avenue. The Clerk <br />tendered proofs of publication.of notice in the South Bend Tribune <br />and the Tri-County News which were found to be sufficient. Mr. <br />Farrand explained that this project was initiated, under Barrett Law, <br />at the request of some property owners in the area and also by the <br />St. Joseph County Health Department because of a health hazard which <br />exists in the area. He noted that the Department of Public Works <br />prepared preliminary plans and a cost estimate for the construction: <br />The purpose of this hearing is to explain the project to the affected <br />property owners and advise them what their assessment will be. He <br />said, at the present time, the City of South Bend is following a <br />policy of paying one-half the costs of such sewer construction. He <br />said there is no indication of how long the City will continue this <br />policy of paying half the cost of construction. The assessments <br />listed for property owners today is one-half the total cost, with the <br />City of South Bend to pay the other half. Mr. Farrand explained that <br />if one more than half of the property owners affected remonstrate <br />against the project, it will not be built unless it should be ordered <br />by the County Health Department. He said, if the project is constructed, <br />the City would take bids on the construction and award the low bid. <br />Upon completion, a public hearing would be held on the final assessment <br />and property owners would be notified of that hearing. The property <br />owner would then have the option of paying his assessment within thirty <br />days of receipt of the billing from the Treasurer's Office or of <br />signing a waiver to allow for the payment to be divided into five <br />equal installments, at six per cent interest, to be billed once each <br />year with tax statements. Mrs. Elliott, speaking for David Smith, <br />Jr., 2215 Hillside, said they have not been allowed to get a permit <br />to put a new septic system in and they need this sewer. Mrs. Dorothy <br />Cressy, 2214 Delaware Street, said she is the only house on Delaware <br />and did not know why she was included in the project as she has <br />own septic system and dry well. Mr. Frank Rozmann, 2221 Hillside <br />Avenue, said he lives on a corner lot on Hillside and Phillipa and <br />asked where the tap would be placed. Mr. Farrand said the contractor <br />contacts the property owner and asks where the tap should be placed. <br />James Lahey pointed out that much of the property concerned is wooded <br />and there are no streets and said it would not seem logical to put <br />sewers in if the streets are not going to be completed. Mr. Farrand <br />said sewers are not planned for the areas which have no streets. <br />Eugenia Schultz, 2021 Carlisle, said she could see no purpose in <br />putting the sewers in. Mr. Matthew Horvath, 2016 S. Olive Street, <br />said he would like to hook up on Olive Street and said he did not see <br />why sewers would be put in where there are no houses. Ile asked if they <br />could see the plans showing where the sewers are to be constructed. <br />Mr. Farrand said the plans are available for inspection and Mr. Wells <br />would be glad to answer any questions. Mr. Ervin Derda asked that the <br />members of the Board introduce themselves which was done. Mr.Derda <br />1 <br />
