L. 2 2 <br />REGULAR MEETING <br />SEPTEMBER 20, 1976 <br />PROJECT COMPLETION AFFIDAVIT AND CHANGE ORDER #1 APPROVED - <br />DONMOYER STREET EXTENSION <br />Mr. Farrand submitted to the Board the Project Completion Affidavit <br />and Change Order #1 for the construction of the Donmoyer Street <br />extension. The total cost of the project was $29,251.43. The Change <br />Qrder;.amounted in -a decrease of $2,306.82'. It was noted that no <br />Maintenance Bond was submitted. Upon motion made by Mr. Farrand,, <br />seconded and carried, the Project Completion Affidavit and Change <br />Order #1 were approved, subject to submission ,of a satisfactory <br />Maintenance Bond from Rieth-Riley Construction Company. <br />POLICE DEPARTMENT BODY ARMOR VALID BID <br />The Board received the following recommendation from Deputy City <br />Attorney Georgia Luks regarding the bid of Second Chance, Inc. for <br />body armor for the Police Department. The bid was opened last weed:, <br />but was referred to the Legal Department to determine whether or not <br />it was a valid bid: <br />IC 33-16-2-4 states that any notorial act not attested by the <br />notary seal shall be void. <br />However, there is authority by the Attorney General that a rubber <br />stamp complies with the requirement of 33-16-2-4. 1965 A.G. 44. <br />Therefore, the bid tendered by Second Chance, Incorporated was <br />properly notarized. <br />There is no similar legislation with regard to corporate seals. <br />IC 23-1-2-2. <br />Therefore, if the Secretary -Treasurer has the authority to bind <br />the Second Chance, the ,bid is valid. <br />Upon_m.otion made by Mr. Farrand, seconded and carried, the Board <br />accepted the recommendation of the Legal Department and publicly_ <br />read the following bid: <br />Second Chance Body Armor Bid was signed by Clinton E. <br />Central Lake, Michigan Davis, non -collusion affidavit <br />was in order in the amount of <br />$1,000. accompanied the bid. <br />Bid - Soft Body Armor Second Chance Model Z-Mini MC. Custom Fitted <br />any size. Unit Price - $108.00. <br />Upon motion made, seconded and carried, the bid of Second Chance. <br />Body Armor was referred to the Bureau of Police for review and recom- <br />mendation. <br />RECO12 ENDATION ON PETITION TO VACATE NORTH -SOUTH ALLEY BETWEEN <br />BENDIX DRIVE AND GOODLAND FROM GREEN'STREET NORTH <br />The Department of Public Works reported to the Board that the petition <br />of Hindsley, Inc. d/b/a Thrifti Rent-A-Car to vacate the north -south <br />alley between Bendix Drive and Goodland, from the north right-of-way <br />line of Green Street north to the south right-of-way line of a 14 <br />foot easterly -westerly alley north of Green Street, had been reviewed <br />and they have no objection to the vacation, but noted the 4 foot wide <br />strip of land off the northerly side of Lot 38 and 36 and recommended <br />it be dedicated for additional alley width by the Traffic Department. <br />Upon motion made, seconded and carried, the report was ordered filed <br />and the petition was referred to the Area Plan Commission for their <br />review and a public hearing. <br />RECOMMENDATION ON PETITION TO VACATE PORTION OF PARALLEL STREET <br />The Department of Public Works reported to the Board that the.peti- <br />tion of G & N Warehouse & Packaging, Inc. to vacate a portion of <br />Parallel Street from the east right-of-way line of Jackson Street, <br />east to the west right-of-way line of Con -Pail Railroad (Michigan <br />Central Railroad), had been reviewed and they have no objection <br />to the vacation, subject to the rights of public utilities. Upon <br />motion made, seconded and carried, the report was ordered filed and <br />and the petition was referred to the Area Plan Commission for their <br />review and a public hearing. <br />1 <br />
