4_ <br />REGULAR MEETING <br />SEPTEMBER 13, 1976 <br />Midwest Fire & Safety Company, Tnc. Bid was signed by Thomas Frederick, <br />Indianapolis, Indiana non -collusion aff idavit.was in order <br />and a 10% bid bond was submitted. <br />Bid - $4,380.00. Unit prices were submitted for the items listed in <br />the specifications. <br />Upon motion made by Mr. Farrand, seconded by Mr. Mullen and carried, <br />the bids were referred to the Bureau of Fire for review and <br />recommendation. <br />OPENING OF BIDS - BODY ARMOR, BUREAU OF POLICE <br />This was the date set for receiving bids f_or.body armor for the <br />Bureau of Police. There were no bids received. Mr. Farrand said <br />it was his understanding that since bids were sought and none received, <br />the Police Department could now negotiate the purchase of the equipment. <br />Mr. Brunner suggested that the matter be referred to his office for <br />review and a legal opinion as. to whether the Police Depar.tmen.t can <br />now negotiate the sale privately. Mr. Mullen.said he would recommend <br />that, based on the determination of the City Attorney's office as to. <br />whether the purchase can now be negotiated, the City Controller would <br />meet with Police Department representatives to decidee on the procedure <br />to be followed in:the purchase. Upon motion rude by Mr. Brunner, <br />seconded by Mr. Mullen and carried, the matter of possible negotiation <br />for the purchase of body armor for the Bureau of Police was referred <br />to the City Attorney's Office and the City Controller's Office for. <br />review and recorunendation. <br />A o <br />PUBLIC HEARING - ASSESSMENT POLL, VACATION RESOLUTION 110 3428 <br />This being the date set, hearing was held on the Assessment Roll <br />for Vacation Resolution No. 3428, for the vacation of the north - <br />south alley running north from Marion Street to the intersection of <br />said alley with the east -west alley running west from St. Joseph <br />Street. The Clerk tendered proofs of publication of notice in the <br />South Bend Tribune and the Tri-County News which were found to be <br />sufficient. No remonstrators appeared and no written remonstrances <br />were filed with the Board. Upon motion made by Mr.Farrand, seconded <br />by Mr. Brunner and carried, the Assessment Roll showing $0.00 net <br />damages and $0.00 net benefits was approved and said resolution <br />is in all things ratified and confirmed and said proceedings closed. <br />TAXI LICENSE APPROVED - JAPES ELDER <br />The Board received the application for taxi license for James Elder <br />on which the Police Department had recommended denial and City <br />Controller Peter H. Mullen's recommendation that Mr. Elder appear <br />before the Board today to present any pertinent information. Mr. <br />Elder was present. Mr. Mullen. asked Mr. Elder if his license was <br />suspended at the present time and Mr. Elder said it was not. <br />He said his license was suspendedesome,years ago, on the point <br />system, but not for a traffic violation and not in the past eight <br />years. Mr. Mullen asked Mr. Elder if he was driving for some one <br />now. A representative of the Courtesy Cab Company was present <br />and advised the Board that Mr. Elder was driving for that company <br />and was doing a good job and the company has had no problems. <br />Mr. Mullen made a motion that the taxi license of James Elder be <br />approved, seconded by Mr. Brunner and carried. <br />TAXI LICENSE APPROVED - RALPH ALVAREZ <br />The Board had received the application for taxi license for Ralph <br />Alvarez on which the Police Department had recommended denial and <br />City Controller Peter H. Mullen's recommendation that Mr. Alvarez <br />appear before the Board today to present any pertinent information. <br />Mr. Alvarez was present. Mr. Brunner asked Mr. Alvarez whether he <br />had.a valid driver's license at this time and Mr. Alvarez said he <br />did. Mr. Brunner asked Mr. Alvarez whether he was on parole or <br />probation. Mr. Alvarez said he was not. Mr. Mullen asked Mr. <br />
