Q .�f' ^ tti=c* <br />_ <br />REGULAR MEETING AUGUST 9, 1976 <br />PUBLIC HEARING ON ASSESSMENT ROLL VACATION RESOLUTION NO. 3388 <br />This being the date set, hearing was held on the Assessment Roll <br />for Vacation Resolution.No. 3388 for the vacation of the <br />northwest -southeast alley between George Avenue,and Marietta <br />Street north of the Cooper Bridge right-of-way from the bridge <br />northwest to the south right-of-way line of the first southwest - <br />northeast alley between Lots 14 and 15 of Frantz 2nd Addition and <br />Lot 13 of Frantz 3rd Addition, City of South Bend.. The Clerk <br />tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri-County News which were found to be sufficient. No <br />remonstrators having appeared and no written remonstrances having <br />been received, upon motion made by Mr. Farrand, seconded by Mr. <br />Brunner and carried, the Assessment Roll showing $0.00 net damages <br />and $0.00 net benefits was approved and said Resolution is in all <br />things ratified and confirmed and said proceedings closed. <br />HEARING ON TAXI LICENSE- ROBERT KLOPENSTINE <br />Mr. Farrand noted that the City Controller had denied the application <br />of Robert Klopenstine for transfer of a taxi driver's license from <br />Ivan Brockway to Mr. Klopenstine. The denial was based on the <br />recommendation of the Police Department.that answered "No" to the <br />question on the taxi driver's application "Have you ever been <br />arrested or convicted of any crime?". Mr. Klopenstine said the <br />conviction was thirty years ago. Deputy City Attorney Georgia <br />Luks recommended to the Board that the application be approved. <br />Mr. Farrand said, based on Mr. Klopenstine's presentation today and <br />the recommendation of the Deputy City Attorney, he would move that <br />`Q the application of Robert Klopenstine to drive Courtesy Cab No. 11 <br />be approved. Mr. Brunner seconded the motion and it carried. <br />FILING OF ASSESSMENT ROLL - VACATION RESOLUTION NO. 3428 <br />Rollin E. Farrand, City Engineer, files an Assessment Roll <br />for Vacation Resolution No. 3428 for the vacation of the north -south <br />alley running north from Marion Street to the intersection of said alley <br />with the east -west alley running west from St. Joseph Street. The <br />following. property may be injuriously or beneficially.affected by <br />such vacation: <br />Lots 6 and 7 of Rockstroh's Subdivision and Lots 121 to. 126 <br />of the Original Plat of South Bend. <br />The Board finds that each of said lots have been benefited in <br />the amount of $0.00 and damaged in the amount of $0.00. <br />Upon motion made by Mr.,Farrand, seconded by Mr —Brunner and carried <br />the Assessment Roll was filed and a public hearing was set for <br />Monday, September 13, 1976. <br />FILING OF PETITION TO VACATE ALLEY EAST OF BENDIX DRIVE <br />Wilford Mayette, Attorney for William Hindsley, d/b/a Thrifti-Rent- <br />A-Car and Triple A Credit Union, files a petition to vacate the <br />east -west alley east of Bendix Drive, running north from Greene <br />Street. The petitioner wishes to construct a building in the area <br />if the vacation is granted. Upon motion made by Mr. Farrand, <br />seconded by Mr. Brunner and carried, the petition was ordered filed <br />and referred to.the Department of Engineering for a utility check <br />and recommendation. <br />CONTRACT APPROVED - DONMOYER STREET EXTENSION <br />The contract with Rieth-Riley Construction Company for the Donmoyer <br />Street Extension from Michigan to Main Street was submitted to the <br />
