REGULAR MEETING <br />JULY 26,,1976 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m. on Monday, July 26, 1976 by President Rollin E.�Farrand, <br />with Mr.. Farrand,,Mr. Brunner and -Mr. Mullen present. Deputy City <br />Attorney Georgia Luks was also present. <br />MINUTES OF PREVIOUS MEETINGS APPROVED <br />Mr. Brunner reported that <br />been reviewed and he made <br />as submitted. Mr. Mullen <br />the minutes of the.July 19 meeting had <br />a motion that the minutes be approved <br />seconded the motion and it carried. <br />Mr. Farrand noted that a special meeting was held on July 17 to <br />approve a title sheet for the construction of the Beverly Place <br />Industrial Sanitary Sewer. Minutes have been reviewed and Mr. Farrand <br />made a motion that the minutes be approved as submitted. Mr. Mullen <br />seconded the motion and -it carried. <br />HEARING CONTINUED - FENCEENCROACHMENT AT 807.N. OLIVE <br />Georgia Luks, Deputy City Attorney, reported to the Board that she <br />had reviewed the matter -lo.fI & fence wh•i.ch, was installed by Benedict <br />Leyba at 807 11. Olive Street which is encroaching on the public right- <br />of-way. Mrs. Luks said the City can order the fence removed. However, <br />she said she has reviewed the matter with Rollin Farrand, Director <br />of Public Works, and, at this time, she would recommend that the City <br />accept the agreement submitted by Attorney Jack Dunfee on behalf of <br />Mr. Leyba to allow the fence to remain until such time as the City <br />needs the right-of-way at which time the fence could be ordered <br />removed. Mr. Farrand noted that Jack Dunfee, Attorney for Mr.-Leyba, <br />was present and he asked Mr. Dunfee if there was any possibility <br />that Mr. Leyba would compromise and move the fence back three feet from <br />the sidewalk line. Mr. Farrand said this would satisfy everyone. <br />Mr. Dunfee said Mr. Leyba was not present and he would have to consult <br />with him. He said this would be a concession and Mr. Leyba might <br />be willing to consider it. Mr. Wells then asked whether the recommenda- <br />tion was to bring the fence back three feet from the property line. <br />Mr. Farrand said this is what he would prefer. Pictures of the <br />property in question were reviewed by the Board and Mr. Dunfee and <br />Mr. Farrand asked if the fence could be moved back so it would be <br />just in front of the signs on the property. Mr. Dunfee said that would <br />be moving the fence more than half the distance. He said he would <br />discuss the matter with Mr. Leyba and report back to the Board. Mr. <br />Dunfee left the meeting to telephone Mr. Leyba. He returned and asked <br />for a one week delay on the matter and noted.that it has been under <br />advisement for more than ten months. He said he and Mr. Leyba would <br />take a look and explore possibilities which might meet with everyone's <br />approval. Mr. Dunfee is to advise the Clerk of the Board if he wishes <br />the matter on the agenda for August 2. <br />APPOINTMENT OF BUILDING COMMISSIONER APPROVED <br />The Board received a recommendation from Mayor Peter J. Nemeth <br />for the appointment of John E. DeLee as Building Commissioner, <br />effective August 1, 1976. Mr. Farrand noted that the Board members <br />have reviewed Mr. DeLee'.s resume. He is a Professional Engineer <br />and has had experience as a plant engineer. This experience would <br />be applicable to the Building Commissioner's job. Upon motion <br />made by Mr. Farrand, seconded by Mr. Brunner and carried, the Board <br />approved the appointment of John E. DeLee as Building Commissioner, <br />effective August 1, 1976. <br />
