REGULAR MEETING JULY 19, 1976 <br />SCRAP DEALER'S LICENSES APPROVED <br />Applications for Scrap Dealer's Licenses for Western Avenue Iron <br />and Metal Company and Bremen Iron & Metal Company were submitted <br />to the Board. The applications have been approved by the Fire <br />Inspection Bureau after site inspections.. These operations are <br />in the newly annexed area on Gertrude Street. Deputy City Attorney <br />W. Gaylen Allsop researched the requirements and, by memorandum, <br />advised that the applicants should be required to comply with all <br />Code requirements, with the exception of the filing of a petition <br />signed by two-thirds of the property owners living within 400 feet <br />of the scrap yard. Mr. Farrand said there probably are not any <br />private owners residing that close to these operations Deputy City <br />Attorney Georgia Luks said she has reviewed the applications and <br />recommends approval. Mr. Farrand said he has driven past both <br />sites and sees no problems. Mr. Mullen asked whether the Municipal <br />Code requires specific fence requirements, etc. -and was advised that <br />Code requirements as to height and type of fence are covered in the <br />Fire Department inspection. Upon motion made by Mr: Farrand, <br />seconded by Mr. Mullen and carried, the applications were approved <br />and the Controller's Office will be advised that City licenses can <br />now be issued. <br />TENT SERVICES APPROVED <br />Mr. Farrand noted that the Board had denied the request of the <br />Berean Seventh Day Adventist to keep a tent they had erected at <br />1201 South Bend Avenue. Rev. Bellinger had indicated he would try <br />to find an alternate site, and the Board had agreed•to consider <br />one. Mr. Farrand said Mr. Bellinger had provided the Board with a <br />letter from the E. & L. Super Market, the old A & P Super Market <br />on North Eddy Street, giving permission for the tent to be erected <br />in their parking lot. Mr. Farrand said the Traffic Department <br />and Police Department reviewed that site and recommended approval <br />and said he made a visual inspection of the site and did not <br />anticipate problems. Mr. Farrand said he gave Mr. Bellinger verbal <br />permission to move the tent and said the Board would approve the <br />request retroactively. Upon motion made by Mr. Farrand, seconded <br />by Mr. Mullen and carried, the Board approved retroactively the <br />request of the Berean Seventh Day Adventist Church to erect a tent <br />for services on the E & L Parking Lot on North Eddy Street, from <br />July 12 through August 31, 1916. <br />PURCHASE AGREEMENT APPROVED - SALE OF 1102 QUEEN STREET <br />A purchase agreement signed by Russell Yockey was submitted to the <br />Board. The agreement covers the sale of a city -owned lot at <br />1102 Queen Street for a total purchase price of $525.00. The <br />agreement was prepared by Deputy City Attorney Georgia Luks. <br />Upon motion made by Mr. Farrand, seconded by Mr. Brunner and <br />carried, the Board approved the purchase agreement and referred it <br />to the City Attorney's office for preparation of the deed and <br />final closing. <br />REQUEST TO ERECT CANOPY DENIED <br />The Board received a request which had been transmitted to <br />Forrest West, Building Commissioner, for permission to erect a <br />canopy at the Louvered Door, 1620 Western Avenue. The Bureau <br />of Traffic and Lighting reviewed the request and consulted with <br />the Indiana State Highway Commission. The State will allow no <br />encroachments of such installations on the state right-of-way <br />so denial was recommended. Upon motion made by Mr. Farrand, <br />seconded by Mr. Mullen and carried, the request was denied, based <br />on the recommendation of the Bureau of Traffic and Lighting and <br />the Indiana State Highway Commission. <br />
