2', <br />REGULAR MEETING <br />MAY 10, 1976 <br />Cleveland Road in Phase Four.of.the Airport Industrial Park. <br />Mr. Wells said Robert Parker, Deputy City Attorney, has <br />recommended that the resolution be adopted. Property involved <br />in the resolution is on the east side of Bendix Drive, between <br />Boland Drive and Cleveland Road. Upon motion made by Mr. Brunner, <br />seconded by Mr. Mullen and carried, the following resolution <br />was adopted: <br />RESOLUTION NO. 14, 1976 <br />WHEREAS, the Board of Public Works has found it necessary in the <br />best interest of the public safety and welfare to construct <br />certain street improvements on Bendix Drive from Lathrop to <br />Cleveland Road, and <br />WHEREAS, the Board of Public Works on January 26, 1976 by Resolu- <br />tion authorized the preparation of necessary design plans for <br />such construction, and <br />WHEREAS, it has now become necessary to proceed by condemnation <br />for the acquisition of the real estate herein described; <br />BE IT RESOLVED that the Board of Public Workshereby directs and <br />authorizes the doing of all acts necessary and desirable to the <br />acquisition by gift, purchase or condemnation of the following <br />real estate, described as follows: <br />Starting at the Northwest corner of said Section 27; thence <br />due south along the West line of said Section 27 a distance <br />of 580 feet; thence due East a distance of 20 feet to the <br />true point of beginning; thence due South along a line 20 <br />feet Eastaof and parallel to the west line of said Section <br />27 a distance of 1417.16 feet more or less; thence due East <br />20 feet; thence due North along a line 40 feet East of and <br />parallel to the West line of said Section 27 a distance of <br />1447.16 more or less; thence in a Southwesterly direction <br />a distance of 36.05 feet more or less to the point of <br />beginning, all in the Northwest one-wyarter (4) of Section <br />27, Twp. 38 North, Range 2 East, German Twp., St. Joseph <br />County, Indiana. <br />BE IT FURTHER RESOLVED that if preceding is brought by condemnation <br />for the acquisition of such real estate, such proceedings shall be <br />brought purusant to the provisions of Acts 1905, Chapter 48, being <br />I.C. 32-11-1-1, 32-11-1-13, as amended. <br />BOARD OF PUBLIC WORKS <br />s/ Peter H. Brunner, Jr. <br />ATTEST: <br />s/ Patricia DeClercq, Clerk <br />Dated this loth day of May, 1976. <br />RIVER BEND PLAZA.REQUESTS <br />Douglas Simpson, Director of River Bend Plaza, submitted to the <br />Board the following requests with his favorable recommendation: <br />A. Clyde Brothers Circus Mini -Parade, Saturday, June 12. <br />The parade would begin at the Morris Civic Auditorium at <br />10:00 a.m.and would consist of elephants, llamas, clowns <br />and other units. The parade would march down the Plaza to <br />the Robertson's block and then return to the Auditorium. <br />Upon motion made by Mr. Mullen, seconded by Mr. Brunner and <br />carried, the request was referred to the Bureau of Traffic <br />and Lighting and the Police Department Traffic Division for <br />review and recommendation. <br />1 <br />
