REGULAR MEETING
APRIL 52 1976
FJ1
LETTER RECEIVED FROM PATRICK BRENNAN.RE- VACATION RESOLUTION 3426
Deputy City Attorney William Stanley transmitted to the Board a
letter from Patrick -Brennan advising the Board that the petitioners
for the vacation.of the alley running west from 500 N. Lafayette,
Vacation Resolution No. 3426, have blocked the alley and are con-
structing curbs. Mr. Brennan asked that a "cease and desist" order
be issued, since the alley is not closed. Mr..Farrand noted that
the petitioner is improving the alley at his own expense and,
whether or not the alley is vacated, they are obligated to return
that alley to reasonable condition. Mr. Farrand said this matter
will be before the Board next Monday, April 12. Mr. Brunner said
it was presumptious on the part of the petitioner to improve the
alley without its being vacated. Mr. Stanley noted that Mr.
Brennan's request should have been directed to the courts. Upon
motion made by Mr. Farrand, seconded by Mr. Mullen and carried,
the letter was ordered filed and will be placed in the Vacation
Resolution file.
There being no further business to come before the Board,,upon
motion made by Mr. Farrand, seconded by Mr. Brunner and carried,
the meeting adjourned at 10:25 a.m.
ATTEST:
4k,e A
Patricia DeClercq, Clerk
,o'llin E. Farrand
