REGULAR MEETING <br />MAY 23, 1977 <br />H. DeWulf Mechanical Contractor_., Bid was: signed by Henry DeWulf, <br />non -collusion affidavit was in order <br />and a 5% Bid bond was submitted. <br />Bid - $229,491.70 <br />Upon motion made by Mr. McMahon, seconded by Mr. Brunner and carried, <br />the bids were referred to the Bureau of Design and Administration <br />for review and recommendation. <br />OPENING OF BIDS - LEASING .OF EIGHT VANS FOR SUIRIER CETA PROGRAM <br />This was the date set for receiving bids for leasing eight vans for <br />the CETA summer program. The Clerk tendered proofs of publication <br />of notice in the South Bend Tribune and the Tri-County News which <br />were found to be sufficient. There were no bids submitted. Mr. <br />McMahon noted that bid notices were mailed to ten local vendors. <br />Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, <br />the Board authorized Elroy Kelzenberg, Director of Manpo�,!er and <br />Training, to negotiate for the leasing of the vans with the concurrence <br />of City Controller, Peter H. Mullen. <br />PUBLIC HEARING - VACATIO14 RESOLUTION NO. 3440-RESOLUTION CONFT_RMED <br />This was the date set for holding a public hearing on Vacation <br />Resolution No. 3440 for the vacation of the second east-west.alley <br />south of Lincolnway West running from the east right-of-way line"of <br />Olive Street east 125 feet to the west right-of-way line of the <br />north -south alley east of Olive Street in Jacob Miller's Addition. <br />The Clerk tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri-County News which were found to be sufficient. <br />Petitioners for the vacation are David and Maxine Bjoraas, owners <br />of Dave's Gym. Mr. & Mrs. Bjoraas were present as was their Attorney, <br />J. Patrick McNamara. Mr. McNarara submitted to the Board a drawing <br />of the proposed expansion of Dave's Gym, which is the reason for the <br />petition to vacate. The petitioners own the property on the north <br />and south sides of the alley. There will be a north -south alley <br />remaining open for emergency vehicles and Mr. Bjoraas has no objection <br />to creating an aisle down the middle of the proposed parking area. <br />Mr. McNamara said it should be pointed out that the petitioner has been <br />in this location for sixteen years with his gym facilities. This is <br />a very reputable business used by professional people and athletes for <br />training. It is one of the best equipped gyms in the business and is <br />a credit to the neighborhood. Adjacent property owners have signed <br />the petition in support of Mr. Bjoraas' request for the vacation. The <br />Area Plan Commission recommended the petition favorably to the Board <br />with the suggestion that a five foot strip, extending fifty feet north <br />and south be granted to the City. Mr. McNamara said there is no problem <br />with this and the strip could be accommodated by setting back a <br />retaining wall in the proposed improvement. No remonstrators appeared <br />and no written remonstrances were filed with the Board. Mr. McMahon <br />noted that the Area Plan Commission did give the petition a unanimous <br />recommendation to the Board and said a number of Mr. Bjoraas' neighbors <br />were present at that hearing and spoke very highly of the operation <br />that he runs. Mr. McMahon said that is the opinion of the Department <br />of Public Works as well. Mr. Mullen asked if the expansion was to <br />include a swimming pool, exercise area and building expansion and Mr. <br />McNamara said that it was. Mr. Mullen said he saw no problem with <br />the petition to vacate. He noted that Mr. Bjoraas was very helpful to <br />the City in their work on adopting a massage parlor ordinance and said <br />this is one of the two or three good, legitimate operations in the City. <br />Mr. Mullen said it was his understanding that Mr. Bjoraas planned to <br />apply for an establishment license under the massage parlor ordinance <br />and for licenses for the technicians. Mr. Bjoraas said he did plan to <br />apply. Mr. Brunner asked if Mr. Bjoraas planned.to make such application <br />in the near future and Mr. Bjoraas said he would apply next week. Mr. <br />McMahon made a motion to confirm Vacation Resolution No, 3440 and <br />refer it to the Division of Engineering for preparation of the Assessment <br />Roll. Mr. Mullen seconded the motion and it carries. <br />
