REGULAR MEETING MAY 2, 1977 <br />REPORT ON MEMORIAL HOSPITAL PETITION TO VACATE ALLEYS <br />The Bureau of Engineering reported that they had reviewed the <br />petition of Pler_iorial.Hospital to vacate the east -west alley from <br />the east side of North Main Street east, the north -south alley from <br />the southside of Bartlett Street south, the east -west alley from <br />the west side of North Main Street west and the north -south alley <br />from Navarre Street north and have no objection to the proposed <br />vacation, subject to the rights and easements of all utilities in <br />the proposed vacated area. A report from the Fire Department <br />noted that Mr. George. DesMarais of Memorial Hospital verbally stated <br />to Capt. Stanley Sparazynski of the South Bend Fire Department on <br />April 18, 1977 that the Hospital would maintain the alleys in case <br />of fire and further stated that the South Bend Fire Department would <br />not be held responsible for any property damage or vehicle damage <br />in the event of a fire. There was a discussion regarding the <br />failure of Memorial Hospital to properly screen their parking areas. <br />Mr. Brunner noted that a Cease and Desist order was issued to <br />Memorial Hospital in November, 1976 giving them one hundred and <br />eighty days to screen their parking area in accordance with agreements <br />made. John DeLee, Building Commissioner, noted that several meetings <br />have been held with Memorial Hospital officials and his Department <br />and with the Bureau of Traffic and Lighting. The hospital had <br />indicated they have hired the Rieth Riley Construction Company to <br />improve the parking areas. Some plans have been submitted to Ralph <br />Wadzinski, Bureau of Traffic and Lighting. Mr. Brunner made a motion <br />that action on the petition be tabled until Play 16, 1977 at which <br />time a report will be made on progress toward screening the parking <br />area. Mr. Mullen seconded .the motion and it carried. Mr. Brunner <br />noted that the City has acted in good faith in this matter in allowing <br />Memorial Hospital time to make arrangements for this screening and <br />would expect the hospital to also act in good faith. He said the <br />City would pursue legal remedies in two weeks if no progress has been <br />made. Mr. DeLee was requested to work with the Legal Departrlent in <br />drafting a letter to Memorial Hospital regarding the matter. <br />REQUEST FOR PARADE RECEIVED - OWEN NESBIT <br />The Board received a request from Owen Nesbit to parade down <br />Mishawaka Avenue on Friday, Play 13, 1977 at 4:00 p.m. from Ironwood <br />Drive to 30th Street, playing a slide trombone and carrying a sign to <br />celebrate the rescission of the motorcycle forced helmet law. Mr. <br />Nesbit said he would march in the street to one side by parked cars <br />but would allow traffic to continue. There was a discussion regarding <br />the proper department to review this request and it was noted that <br />liability insurance would be a requirement. Mr. McMahon suggested <br />that the Clerk be asked to contact Mr. Nesbit to inform him that the <br />Board would not issue a permit for this activity in the street, but <br />he could submit a request for a sidewalk parade. There was a <br />discussion about the possibility of denying the request as it was <br />submitted. Mr. McMahon made a motion that the request be filed and <br />referred to the Bureau of Traffic and Lighting and the Police Depart- <br />ment Traffic Detail for review and recommendation. Mr. Brunner seconded <br />the motion and it carried. <br />COMPLAINT REGARDING ALLEY IN 1700 BLOCK. EWING AVENUE <br />The Board received a letter from Joseph Kasa regarding problems <br />residents of the 1700 block Ewing face because a property owner <br />has placed trash drums out in the alley right-of-way causing problems <br />for vehicles in the alley. Mr. Kasa also noted that thirty inches <br />of the alley have been scraped away from the garages and that cars <br />parking at the Robinson Street exit of the alley make it impossible <br />for vehicles in the alley to make their turns. Mr. McMahon made <br />a motion that the letter be filed and that the property owner at <br />1735 E. Ewing be notified that any trash drums encroaching on the <br />alley right-of-way must be moved. In addition, the Street Department <br />will be requested to investigate the condition of the alley and the <br />Police Department will be asked to check the alleged parking <br />violations at the Robinson Street exit. Mr. Mullen seconded the <br />motion and it carried. Mr. Kasa is to be advised of the Board's action. <br />
