REGULAR MEETING FEBRUARY 28, 1977 A regular meeting of the Board of Public Works was convened at 9 : 30 a.ui. on Monday, February 28, 1977 by President Patrick McMahon, with Mr. McMahon, Mr. Brunner and Mr. Mullen present. Deputy City Attorney Georgia Luks was also present. MINUTES OF PP.EVIOUS°PTEETING APPROVED Mr. McMahon reported that he had reviewed the minutes of the February 21 neeting and lie made a motion that the minutes be approved as submitted. Mr. Brunner seconded the notion and it carried. PUBLIC HEAI;ING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3436 This being the date set, hearing was held on the Assessment Poll for Vacation Resolution No. 3436, 1976 for the vacation of the east -west alley between Randolph Street and Calvert Street, west of Ironwood Drive, from the west right-of-way line of Ironwood Drive running west 135 feet to the east right-of-way line of the north -south alley vest of Ironwood Drive, in Roseland Park addition. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. No remonstrators appeared and no written remonstrances were filed. Deputy City Attorney Georgia Luks advised the Board that she had prepared a quitclaim deed for the dedication of five feet of right-of- way for a turning radius and had submitted the deed to Jack Dunfee, Attorney for the petitioners, for execution. Upon notion made by Mr. McMahon, seconded by Mr. Brunner and carried, the Assessment Roll showing )0.00 net darzages and $0.00 net benefits was approved, subject to the filing of the executed quitclairz deed with the Board, at which time the resolution will be in all things ratified and confirmed and said proceedings will be closed. LETTER FILED - OLIVE -PRAIRIE SIGNALI2ATION The Board received a letter_ from L. R. Sadler, Acting District Engineer for the LaPorte District Office of the Indiana State Highway Commission, indicating that the request for signals at the inter- section of Olive and Prairie has been reviewed by the LaPorte office and their findings have been forwarded to the Division of 'Traffic in Indianapolis, and that the Board would be hearing directly f_ron that office on the matter. Mr. McMahon noted that the request would probably be heard at the March rzeeting of the Highway Commission. Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, the letter was ordered filed .: FILII4G OF PETITION TO VACATE EAST-TTEST ALLEY SOUTH OF LIIdCOLIRlAY WEST David and Maxine Bjoraas file their petition to vacate the second east -west alley south of Lincolnway West running from Olive Street east to the first north -south alley. Upon notion made by Mr. McMahon, seconded by Mr. Mullen and carried, the petition was filed and referred to the Bureau of Engineering for preliminary review and report. AT7ENMEMT 110. 1 APPROVED - CENTUBY CENTURY CONSTRUCTION MANAGETZENT Amendrient No. 1 to the Construction Management for Century Center with Sollitt Construction Company was submitted to the Board. Mr. McMahon reported that the original contract expired January 1, 1977 and this amendment extends the contract through November 1, 1977 and makes provision for palm'ient to be rude to then for work perforried. The amendment has been reviewed by the Legal Department and approved by the Civic Center Building Authority. The amendment provides for payment of $4,000 per month through October 21, 1977. After November 1, 1977 time spent will be reirlbursed at the rate of 825.00 per hour. Mr. McMahon rude a motion that the arlendnent be approved. Mr. Brunner seconded the motion and it carried.
