REGULAR MEETING <br />FEBRUARY 28, 1977 <br />A regular meeting of the Board of Public Works was convened at <br />9 : 30 a.ui. on Monday, February 28, 1977 by President Patrick <br />McMahon, with Mr. McMahon, Mr. Brunner and Mr. Mullen present. <br />Deputy City Attorney Georgia Luks was also present. <br />MINUTES OF PP.EVIOUS°PTEETING APPROVED <br />Mr. McMahon reported that he had reviewed the minutes of the <br />February 21 neeting and lie made a motion that the minutes be <br />approved as submitted. Mr. Brunner seconded the notion and it <br />carried. <br />PUBLIC HEAI;ING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3436 <br />This being the date set, hearing was held on the Assessment Poll <br />for Vacation Resolution No. 3436, 1976 for the vacation of the <br />east -west alley between Randolph Street and Calvert Street, west <br />of Ironwood Drive, from the west right-of-way line of Ironwood Drive <br />running west 135 feet to the east right-of-way line of the north -south <br />alley vest of Ironwood Drive, in Roseland Park addition. The Clerk <br />tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri-County News which were found to be sufficient. No <br />remonstrators appeared and no written remonstrances were filed. <br />Deputy City Attorney Georgia Luks advised the Board that she had <br />prepared a quitclaim deed for the dedication of five feet of right-of- <br />way for a turning radius and had submitted the deed to Jack Dunfee, <br />Attorney for the petitioners, for execution. Upon notion made by <br />Mr. McMahon, seconded by Mr. Brunner and carried, the Assessment Roll <br />showing )0.00 net darzages and $0.00 net benefits was approved, subject <br />to the filing of the executed quitclairz deed with the Board, at which <br />time the resolution will be in all things ratified and confirmed and <br />said proceedings will be closed. <br />LETTER FILED - OLIVE -PRAIRIE SIGNALI2ATION <br />The Board received a letter_ from L. R. Sadler, Acting District <br />Engineer for the LaPorte District Office of the Indiana State Highway <br />Commission, indicating that the request for signals at the inter- <br />section of Olive and Prairie has been reviewed by the LaPorte office <br />and their findings have been forwarded to the Division of 'Traffic in <br />Indianapolis, and that the Board would be hearing directly f_ron that <br />office on the matter. Mr. McMahon noted that the request would <br />probably be heard at the March rzeeting of the Highway Commission. <br />Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, <br />the letter was ordered filed .: <br />FILII4G OF PETITION TO VACATE EAST-TTEST ALLEY SOUTH OF LIIdCOLIRlAY WEST <br />David and Maxine Bjoraas file their petition to vacate the second <br />east -west alley south of Lincolnway West running from Olive Street <br />east to the first north -south alley. Upon notion made by Mr. McMahon, <br />seconded by Mr. Mullen and carried, the petition was filed and <br />referred to the Bureau of Engineering for preliminary review and report. <br />AT7ENMEMT 110. 1 APPROVED - CENTUBY CENTURY CONSTRUCTION MANAGETZENT <br />Amendrient No. 1 to the Construction Management for Century Center with <br />Sollitt Construction Company was submitted to the Board. Mr. McMahon <br />reported that the original contract expired January 1, 1977 and <br />this amendment extends the contract through November 1, 1977 and makes <br />provision for palm'ient to be rude to then for work perforried. The <br />amendment has been reviewed by the Legal Department and approved by <br />the Civic Center Building Authority. The amendment provides for <br />payment of $4,000 per month through October 21, 1977. After November <br />1, 1977 time spent will be reirlbursed at the rate of 825.00 per hour. <br />Mr. McMahon rude a motion that the arlendnent be approved. Mr. Brunner <br />seconded the motion and it carried. <br />
