M <br />I* <br />RE, GULAR 11EETING JANUARY 41 1977 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m, on Tuesday, January 4, 1977 by Thomas J. Brunner, Jr. <br />in the absence of a Chairman. 11r. Brunner and Patrick 11. 11cl1ahon, <br />Director of Public Works, were present, as was Deputy City <br />Attorney Georgia Luks . 11r.. Brunner made a motion that 11r. 11c1lahon <br />be appointed Chairman Pro-Tem for this meeting, until such time <br />as the full Board has the opportunity to elect a President of the <br />Board of Public Works. 11r. 11cliahon seconded the motion and it <br />carried. <br />APPP.OVAL OF III14UTES DELAYED <br />Upon motion made by 11r. 11c1lahon, seconded by 11r. Brunner and <br />carried, the approval of minutes of the December 28 and December <br />30 meetings of the Board was delayed until the next meeting. <br />OPENING OF BIDS - VEHICLE, BUREAU OF ENGINEERING <br />This was the date set for receiving bids for one vehicle for the <br />Bureau of Engineering. The Clerk tendered proofs of publication <br />of notice in the South Bend Tribune and the Tri-County News which <br />were found to be sufficient. The following bids were opened <br />and publicly read: <br />Gates Chevrolet Company Bid was signed by Garry E. Westfall, <br />South Bend, Indiana non -collusion affidavit was in order <br />and a certified check in the amount <br />of $475.00 was submitted. <br />Bid - one 1977 Impala - $5,976.12 <br />less Trade -In 1,227.12 <br />Net $4,749.00 <br />Freeman Spicer Bid was signed by J. Spicer, <br />South Bend, Indiana non -collusion affidavit was in order <br />and a 10% bid bond was submitted. <br />Bid - One 1977 Fury - $5176.97 <br />less Trade -In 100.97 <br />Net 5076.00 <br />Basney-Ford -.Deputy City Attorney Georgia Luks advised the Board <br />that the bid from Basney Ford should not be read, as the non - <br />collusion affidavit was not notarized. Mr. 11cMahon said an <br />improperly executed non -collusion affidavit was considered a <br />substantial defect in the bid and it would not be read. <br />11r. 11c1lahon made a motion that the bids be referred to the Department <br />of Public Works for review and recommendation. 11r. Brunner seconded <br />the motion and it carried. <br />11r. Gene Evans, Civic Planning Association, asked why the City had <br />bid a full-sized car. 11r. 11cllahon explained that this is the City <br />Engineer's car and is used to go back and forth on all public works <br />business, including trips to Indianapolis and Chicago, and must <br />be able to accommodate five or six persons comfortably and, for this <br />reason, the specifications were written for the larger car. <br />PUBLIC IIEARI14G - VACATION RESOLUTION NO. 3435 - NOP.TH-SOUTH <br />ALLEY BET 1EEN 11EADE AND FRE11014T STREETS <br />This Baas the date set for holding a public hearing on Vacation <br />P.esolution No. 3435, for the vacation of the north -south alley <br />between Meade Street and Fremont Street, from the south right-of-way <br />line of Lawton Street to the north right-of-way line of the east - <br />west alley between Lawton -Street and Orange Street, the alley being <br />
