412 REGULAR MEETING SEPTEMBER 13, 1982 DENY LICENSE APPLICATION FOR SECONDHAND DEALER - WALTER FUELL, 1404 SOUTH MICHIGAN Mr. Leszczynski stated that Walter Fuell, 104 East Broadway Street, South Bend, had applied for a secondhand dealer's license at 1404 South Michigan Street. Mr. Leszczynski advised that the necessary inspections and review had been conducted and that the property was properly zoned for such an establishment, adequate off-street parking was available, and all fire code requirements had been complied with. Mr. Leszczynski noted, however, that according to the fire inspection conducted on August 24, 1982, Fire Inspector Richard Kaczmarek had noticed there was no stock on hand within the building, but there were three video games.on the premises. Mr. Hill stated that, in December of 1981, Mr. Fuell had applied for an amusement arcade license which had been turned down by the Board because the location of a game room at that location was a violation of the controlled usage section of the Municipal Code. He explained that such video games and pinball machines would still be in violation of the code and were also not permitted under a secondhand dealer's license. Upon a motion made by Mr. Hill, seconded by Mr. Kernan and carried, the license application of Walter Fuell for a secondhand dealer's license at 1404 South Michigan Street was denied. APPROVE OPEN AIR STAND LICENSE ON RIVER BEND PLAZA - CAMBODIA'S EGG ROLL An application was submitted for Board approval by Thien Van Trinh, 1009 Patty Lane, for an open air stand license on River Bend Plaza for the sale of concessions, including egg rolls, beef barbeque on a stick and soft drinks. Mr. Leszczynski noted that, if approved, an inspection would be required by the Health Department and the Neighborhood Code Enforcement Office to determine that all health laws and other city code laws would be in conformance. Mr. Steve Matz, 602 Ostemo, representing Mr. Van Trinh, asked for the Board's approval of the location of the stand. Mr. Hill explained that the Board had previously approved the license application for Mr. Van Trinh on August 2, 1982; however, permission for the use of River Bend Plaza had been held up pending a polling of the downtown merchants to see if there was any objection to the location of the stand. Mr. Leszczynski stated that the response of the downtown merchants was generally favorable. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the license application was approved, subject to payment of the necessary fees, required insurance and necessary health inspections. Mr. Leszczynski advised that the stand would be located as near as possible to the Pretzel Palace. FILE ENVIRONMENTAL CLEANUP OF LOTS A list containing 148 lots ordered cleaned by the Director of the Neighborhood Code Enforcement Office was submitted. It was noted that property owners had been advised to clean up the lots and had failed to do so. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the environmental list was filed. APPROVE CONTRACTORS' BONDS Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the following Contractors' Bonds were approved as recom- mended by Ray S.
