412 <br />REGULAR MEETING SEPTEMBER 13, 1982 <br />DENY LICENSE APPLICATION FOR SECONDHAND DEALER - <br />WALTER FUELL, 1404 SOUTH MICHIGAN <br />Mr. Leszczynski stated that Walter Fuell, 104 East Broadway Street, <br />South Bend, had applied for a secondhand dealer's license at 1404 <br />South Michigan Street. Mr. Leszczynski advised that the necessary <br />inspections and review had been conducted and that the property <br />was properly zoned for such an establishment, adequate off-street <br />parking was available, and all fire code requirements had been <br />complied with. Mr. Leszczynski noted, however, that according <br />to the fire inspection conducted on August 24, 1982, Fire Inspector <br />Richard Kaczmarek had noticed there was no stock on hand within the <br />building, but there were three video games.on the premises. Mr. <br />Hill stated that, in December of 1981, Mr. Fuell had applied for <br />an amusement arcade license which had been turned down by the <br />Board because the location of a game room at that location was a <br />violation of the controlled usage section of the Municipal Code. <br />He explained that such video games and pinball machines would <br />still be in violation of the code and were also not permitted <br />under a secondhand dealer's license. Upon a motion made by Mr. <br />Hill, seconded by Mr. Kernan and carried, the license application <br />of Walter Fuell for a secondhand dealer's license at 1404 South <br />Michigan Street was denied. <br />APPROVE OPEN AIR STAND LICENSE ON RIVER BEND PLAZA - <br />CAMBODIA'S EGG ROLL <br />An application was submitted for Board approval by Thien Van Trinh, <br />1009 Patty Lane, for an open air stand license on River Bend Plaza <br />for the sale of concessions, including egg rolls, beef barbeque on <br />a stick and soft drinks. Mr. Leszczynski noted that, if approved, <br />an inspection would be required by the Health Department and the <br />Neighborhood Code Enforcement Office to determine that all health <br />laws and other city code laws would be in conformance. Mr. Steve <br />Matz, 602 Ostemo, representing Mr. Van Trinh, asked for the <br />Board's approval of the location of the stand. Mr. Hill explained <br />that the Board had previously approved the license application for <br />Mr. Van Trinh on August 2, 1982; however, permission for the use <br />of River Bend Plaza had been held up pending a polling of the <br />downtown merchants to see if there was any objection to the <br />location of the stand. Mr. Leszczynski stated that the response <br />of the downtown merchants was generally favorable. Upon a motion <br />made by Mr. Leszczynski, seconded by Mr. Hill and carried, the <br />license application was approved, subject to payment of the <br />necessary fees, required insurance and necessary health inspections. <br />Mr. Leszczynski advised that the stand would be located as near as <br />possible to the Pretzel Palace. <br />FILE ENVIRONMENTAL CLEANUP OF LOTS <br />A list containing 148 lots ordered cleaned by the Director of the <br />Neighborhood Code Enforcement Office was submitted. It was noted <br />that property owners had been advised to clean up the lots and <br />had failed to do so. Upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Hill and carried, the environmental list was filed. <br />APPROVE CONTRACTORS' BONDS <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the following Contractors' Bonds were approved as recom- <br />mended by Ray S.
