306 <br />REGULAR MEETING MAY 24, 1982 <br />2. And full compliance, within the same 60-day <br />time period, with applicable requirements <br />regarding establishment of a buffer strip, <br />and any other changes necessary in fencing <br />as a result of said buffer strip. <br />BE IT FURTHER RESOLVED that this Resolution°shall be subejct <br />to approval and ratification by the Common Council. <br />Dated: May 24, 1982 BOARD OF PUBLIC WORKS <br />s/ John E. Byers, Clerk <br />Mrs. Pfotenhauer explained that the above property.was currently <br />being used as a scrap yard under a license issued to South Bend <br />Auto Parts. Mr. Herman T. Williams, 20201 Dice Street, South <br />Bend, Indiana, was in the process of purchasing the property <br />for operation of a scrap yard under the name of South Main Auto <br />Parts. She explained that it will be necessary for Mr. Williams <br />to meet certain requirements as stipulated in the new licensing <br />Ordinance #6998-81 passed by the Common Council on November 9, <br />1982. She advised that there were no violations of the applicable <br />zoning laws nor size of the lot; however, a 15-foot buffer strip <br />was required if there was new ownership of the scrap yard. She <br />recommended the Board adopt the above resolution approving the <br />license and forward a resolution to the Common Council requesting <br />its approval as required, but stipulate that, within 60 days of <br />commencement of operation under South Bend Auto Parts, the <br />appropriate buffer strip and any other changes necessary in <br />conjunction with fencing as a result of said buffer strip be <br />completed. Mr. Hill advised that it would be unfair to expect <br />the changes to be made prior to approval of the license since <br />Mr. Williams had not yet finalized the purchase of the property <br />and did not have access to the property at this point. He pointed <br />out that a condition of the purchase of the property by Mr. <br />Williams was contingent upon the Board and Council approving a <br />license for its operation as a scrap yard. Upon a motion made <br />by Mr. Kernan, seconded by Mr. Hill and carried, the above <br />resolution approving a scrap dealer's license for South Main <br />Auto Parts, 1819 South Main Street, was approved, subject to <br />the completion of a required buffer strip and related fencing <br />within 60 days of the commencement of a scrap yard operation <br />under the name of South Main Auto Parts. The Clerk was <br />instructed to forward a similar resolution to the Common Council <br />for its concurrence. <br />APPROVE HANDICAPPED PARKING PERMITS <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and <br />carried, the following handicapped parking permits were approved <br />and referred to the Deputy Controller's Office for issuance: <br />Rev.
