I �1 REGULAR MEETING APPROVE CERTIFICATE OF SUBSTANTIAL COMPLETION - INTERIOR FINISHES, INC. (FIRST BANK CENTER PROJECT) MAY 24, 1982 Mr. Leszczynski submitted a Certificate of Substantial Completion for Interior Finishes, Inc. for its portion of work on the First Bank Center Project in the total contract amount of $151,294.94. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the Certificate of Substantial Completion was approved and the Waiver of Lien filed. FILING OF PARK BOARD RESOLUTION TO ACQUIRE CITY -OWNED LAND FOR PARK PURPOSES (EAST RACE) Mr. Hill explained that the Park Board, on December 8, 1980, had passed a declaratory resolution to acquire a parcel of property for the construction of a water related raceway, said parcel being owned by the City of South Bend and located in the East Race area south of Colfax Avenue. Mr. Hill further explained that, according to state law, if two governmental entities act on resolutions indicating their intent to acquire and transfer property from one entity to the other, such a transfer can be affected upon terms and conditions agreed to by the governmental bodies. He advised that the next item on the agenda was a similar resolution of the City of South Bend stating its intent to transfer the parcel in question. Upon a motion made by Mr. Leszczynski., seconded by Mr. Hill and carried, the resolution was filed. ADOPTION OF RESOLUTION NO. 14, 1982 (TRANSFER TO PARK BOARD FOR PARK PURPOSES - EAST RACE) RESOLUTION NO. 14, 1982 RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND TO TRANSFER LAND FOR PARK PURPOSES TO THE BOARD OF PARK COMMISSIONERS OF THE PARK DISTRICT OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, the Board of Park Commissioners of the Park District of the City of South.Bend on the 8th day of December, 1980, passed a declaratory resolution to acquire a parcel of property for the construction of a water related raceway, said parcel of property being referred to as Parcel IV - East Race; and WHEREAS, a portion of said real estate is now owned by the City of South Bend through its Board of Public Works, said real estate being located in St. Joseph County, Indiana, and described as follows: A parcel of land being all that part of the East Race located in the Northwest Quarter of Section 12, Township 37 North, Range 2 East in South Bend, Indiana, extending from the center- line of Colfax Avenue, Southerly to the St. Joseph River as conveyed to the Municipal City of South Bend, Indiana in Deed Record Book 671, Page 428 in the Office of the Recorder of St. Joseph County, Indiana and.being more particularly described as follows, viz: Beginning at the point of intersection of the South right-of-way line of said Colfax Avenue with the Easterly line of said East Race, said beginning point being 167.64 feet North 890-52'-09" West of the intersection of said South right-of-way line with the West right-of-way line of Niles Avenue; thence South 40-50'-43" East, along an Easterly line of said East Race, a distance of 411.17 feet to a point on the North right-of-way
