243 <br />REGULAR MEETING MARCH 22, 1982 <br />paid by Murphy/Jahn and $30,000.00 to be paid by Shand, Morahan <br />& Company on behalf of the Potomac Insurance Company. Mr. <br />Leszczynski advised that the addendum was necessary because <br />the actual amount of the remedial work exceeded the $80,000.00 <br />figure by $13,181.72. The addendum acknowledged receipt of <br />the additional amount from Shand, Morahan & Company, said amounts <br />to be paid to the general contractor, Brown & Brown, for the <br />remedial work. Mr. Kernan stated that, on the basis of the work <br />completed and the agreement on a final settlement of costs, <br />Murphy/Jahn was being released from any further claims, damages <br />and costs arising out of the cracked column and related <br />structural failure in the parking facility. Upon a motion <br />made by Mr. Leszczynski, seconded by Mr. Kernan and carried, <br />the addendum was approved. <br />APPROVE STREET LIGHTING CONTRACTS WITH INDIANA & MICHIGAN ELECTRIC <br />Mr. Leszczynski submitted three contracts between the city and <br />I & M Electric for street lighting throughout the city. He <br />explained that the city's present contracts with I & M would <br />be updated by the execution of the new contracts in accordance <br />with the rate increase approved by the Public Service Commission <br />in 1981, to be effective on April 1, 1982. lie advised that the <br />city had anticipated the rate increases in the current budget. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan <br />and carried, the contracts were approved. <br />APPROVE COMMUNITY GARDENS PROJECT FOR 1982 <br />Mr. Leszczynski stated that requests had again been received by <br />the Board for permission to garden on city -owned lots. He <br />explained that the program has been in effect for the past few <br />years and interested citizens are asked to sign a release form <br />which sets forth certain rules and regulations pertaining to <br />the use of the property. Upon a motion made by Mr. Kernan, <br />seconded by Mr. Leszczynski and carried, the project was approved. <br />REQUEST OF MICHIANA WATERSHED FOR ANNUAL ST. JOSEPH RIVER RUN <br />A request was received from Richard D. Carey, President of the <br />Michiana Watershed, for permission to again hold the annual St. <br />Joseph River Run on Saturday, May 15, 1982, beginning at Leeper <br />and Veterans Memorial Parks between 11:00 a.m, and 1:00 p.m. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan <br />and carried, the request was referred to the Bureau of Traffic <br />and Lighting and the Police Traffic Division for review and <br />recommendation. <br />REQUEST TO CONDUCT MICHIANA BLOOD DONORS RUN - <br />SOUTH BEND MEDICAL FOUNDATION <br />A request to conduct.a marathon or run on Sunday, May 23, 1982, <br />commencing at 9:00 a.m, from Leeper Park running northwest along <br />Riverside Drive to Pinhook Park and back was received from the <br />South Bend Medical Foundation. Upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Kernan and carried, the request <br />was referred to the Bureau of Traffic and Lighting and the <br />Police Traffic Division for review and recommendation. <br />REQUEST TO CONDUCT JULY 4TH RACE - PAUL BOEHM MINI -MARATHON <br />The South Bend Public Recreation Department submitted a request <br />for permission to conduct a Fourth of July mini -marathon utilizing <br />Howard Park and Northside Boulevard and a diversion to the old <br />railroad foot bridge to the west side of the river and the side- <br />walk on Jefferson Street back to Howard Park. It was noted that <br />the race, commonly called the Paul Boehm Mini -Marathon, had been <br />held in the past in June in the Rum Village neighborhood. Upon <br />a motion made by Mr. Leszczynski, seconded by Mr. Kernan and <br />carried, the request was referred to the Bureau of Traffic and <br />Lighting and the Police Traffic Division for review and recommendation. <br />
