231 <br />REGULAR MEETING <br />MARCH 15, 1982 <br />The regular meeting of the Board of Public Works was convened at <br />9:30 a.m., on Monday, March 15, 1982, by President John E. <br />Leszczynski, with Mr. Leszczynski, Mr. Richard L. Hill and Mr. <br />Joseph E. Kernan present. Also present was Assistant City <br />Attorney Carolyn Pfotenhauer. <br />MINUTES OF PREVIOUS MEETING APPROVED <br />Upon a motion made by Mr. Hill, seconded by Mr. Kernan and carried, <br />the minutes of the March 8, 1982, regular meeting of the Board <br />were approved as submitted. <br />ADOPTION OF RESOLUTION NO. 9, 1982 - APPROVE LEASE OF STORYLAND ZOO <br />Mr. Leszczynski stated that the Mayor had requested the Board to <br />consider the lease of Storyland,Zoo to a not -for -profit corpora- <br />tion. Mrs. Pfotenhauer explained that, under the new statutes <br />regulating the disposal of city property, whether by sale or <br />lease, the Mayor must approve its sale or lease and must <br />designate a board to hold a public hearing on the advisability <br />of leasing or selling any particular piece of property. Mr. <br />Leszczynski announced that this was the public hearing to <br />(� consider lease of Storyland Zoo. The Clerk tendered proofs of <br />publication of notice in the South Bend Tribune and the Tri- <br />County News which were found to be sufficient. Mayor Roger 0. <br />Parent asked that the Board consider leasing the facility to <br />the Orphan Animal Care Facility, Inc., a not -for -profit <br />organization dealing with the care of wild animals. Ile felt <br />such a use would provide a good community service and utilize <br />a facility that would otherwise remain vacant. He stated that <br />negotiations were underway for lease of the facility and .that <br />it was not the intent of the city to make money on the lease of <br />the facility, but it was hoped the facility could be used at <br />little or no cost to the City of South Bend. He stated that, <br />at present, running water was available only during the summer <br />months when the zoo would normally be open, and, if the facility <br />was leased to Orphan Animal Care, arrangements would need to be <br />made by the city for the supply of water for the winter and <br />summer months. Mr. James Seitz, Superintendent of the Park <br />Department, advised that the Park Board was interested in <br />putting the facility to this particular type of use which would <br />be compatible to the function of the zoo rather than allowing <br />the facility to sit idle and deteriorate and become the object <br />of vandalism. Upon a motion made by Mr. Leszczynski, seconded <br />by Mr. Hill and carried, the public hearing was closed. Upon a <br />motion made by Mr. Hill, seconded by Mr. Leszczynski and carried, <br />the following Resolution No. 9, 1982, was adopted: <br />RESOLUTION NO. 9, 1982 <br />WHEREAS, the Board of Public Works of the City of South <br />Bend, Indiana, has been designated by the Mayor as the body <br />which gives notice, conducts hearings, and makes recommenda- <br />tions as to the desirability of sale or lease of City owned <br />property, pursuant to I.C. 36-1-11-3; and <br />WHEREAS, the City of South Bend, Indiana, owns a facility <br />known as Storyland Zoo which is located within the Rum Village <br />Park in the City of South Bend; and <br />WHEREAS, said zoo facility has been closed by the Board <br />of Park Commissioners and is no longer operated for a <br />public purpose due to lack of funding; and <br />WHEREAS, the Board of Park Commissioners has continued <br />to maintain the vacant facility in order to prevent deteriora- <br />tion and vandalism of said facility and the Board of Park <br />Commissioners does not intend to reopen the facility for <br />a public purpose within the reasonably foreseeable future; and <br />
