114 <br />REGULAR MEETING NOVEMBER 2, 1981 <br />Neighborhood Code Enforcement - <br />1976 Chevrolet Chevette <br />Serial No. 1BO816YI4379 <br />WHEREAS, Chapter 186, Acts of 1967, of the Indiana General <br />Assembly, permits the sale of personal property no longer <br />needed or obsolete. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend that the above listed vehicle is <br />obsolete and not needed by the City of South Bend. . <br />BE IT FURTHER RESOLVED that the Bureau of Vehicle Maintenance <br />be authorized to scrap said vehicle and that it be removed <br />from the City Vehicle Inventory. <br />Adopted November 2, 1981 BOARD OF PUBLIC WORKS <br />s/ John E. Byers, Clerk <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan <br />and carried, the above resolution was adopted. <br />APPROVE PURCHASE AGREEMENTS FOR SALE OF PORTION OF <br />BROWNFIELD PARK TO LOCK JOINT TUBE COMPANY <br />Mr. Leszczynski advised that Lock Joint Tube Company, in a <br />letter dated October 28, 1981, had accepted the city's counter- <br />offer for the sale of the portion of Brownfield Park located at <br />the northwest corner of Angela and Riverside Drive. He stated <br />that, at the Board meeting of October 5, 1981, the bid of Lock <br />Joint Tube Company in the amount of $11,430.00 for purchase of <br />the property had been rejected because the bid was not equal to <br />the offering price of $18,250.00. At that time, after due <br />consideration, the Board had made the following counter-offer <br />to Lock Joint Tube: That the property be offered for sale at <br />the previously established offering price of $18,250.00; however, <br />a condition of the sale shall provide that, should a subsequent <br />rezoning of the property to light industrial not be approved <br />(thus prohibiting Lock Joint Tube from utilizing the property <br />as intended) the sale would not take place. The stipulation <br />that no structures be constructed without the prior written <br />approval would also remain a condition of the sale. Mr. John <br />Voorde, Councilman at Large, asked if the city would now initiate <br />the rezoning procedure for the property on behalf of Lock Joint <br />Tube. Mr. Hill advised that Lock Joint Tube would initiate the <br />petition since the purchase agreement will be entered into which <br />would enable the company, as potential purchasers, to proceed. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, acceptance of the city's counter-offer by Lock Joint <br />Tube was filed and the Purchase Agreement approved for sale of <br />the property, subject to the above conditions. <br />APPROVE REQUEST TO ADVERTISE TO RECEIVE BIDS AND <br />SIGN TITLE SHEET (SOUTHERNVIEW DRIVE CULVERT) <br />Mr. Ray S. Andrysiak, P.E., requested permission from the Board <br />to advertise to receive bids for the construction of the <br />Southernview Drive culvert, including the removal of concrete. <br />pipe and construction of the culvert and wood guard rails.
