110 <br />REGULAR MEETING NOVEMBER 2, 1981 <br />3110 Riverside Drive, is surplus equipment and not needed <br />by the City of South Bend: <br />WASTE OIL BURNER, SCRUBBER, CONTROL SYSTEM <br />TWO STORAGE TANKS AND MISCELLANEOUS <br />APPURTENANCES <br />WHEREAS, Chapter 186, Acts of 1967, of the Indiana General <br />Assembly, permits the sale of personal property°no longer <br />needed or obsolete. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend that the above listed equipment <br />is surplus and not needed by the City of South Bend. <br />BE IT FURTHER RESOLVED that the Engineering Department be <br />authorized to dispose of said equipment and remove same <br />from the city's inventory list. <br />Adopted: November 2, 1981 BOARD OF PUBLIC WORKS <br />s/ John E. Byers, Clerk <br />Upon a motion made by Mr. Kernan, seconded by Mr. Hill and carried, <br />the above Resolution No. 22, 1981, was adopted. <br />PUBLIC HEARING - IMPROVEMENT RESOLUTION NO. 3516, 1981 <br />(WABASH STREET SANITARY SEWER PROJECT) <br />The public hearing on the construction of sanitary sewers on Wabash <br />Street from Ewing Avenue to Calvert Street, authorized under <br />Improvement Resolution No. 3516, 1981, adopted by the Board on <br />October 19, 1981, was held at this time. The Clerk tendered <br />proofs of publication of notice in the South Bend Tribune and the <br />Tri-County News which were found to be sufficient. Mr. Leszczynski <br />noted that the preliminary assessment roll listed a total cost of <br />the improvement at $54,959.65, with the amount to be assessed to <br />the city, should the project be approved, of $27,479.68. He <br />stated that, unless more than 50% of the affected property owners <br />objected to the construction of the sewer, the Board would proceed` <br />to obtain bids for its construction. Miss Helen Zurawski, owner <br />of Lots 215 and 216, along with her brothers, Andrew and John, <br />expressed support of the sewer project. Mr. Gerald Dhaeze, owner <br />of Lots 204 and 205, reminded Miss Zurawski that the cost of the <br />improvement as listed on the assessment roll did not include hooka - <br />up to the sewer and that additional expense would be incurred by <br />the property owners. He presented a petition signed by all but <br />one of the home owners between Ewing and Calvert who were opposed <br />to the sewer construction. He later indicated that those signatures <br />were obtained from anyone living in the households who was over <br />18 years of age. Mr. Matthew Krizman, stated that he was the <br />owner of one of the many vacant lots in the project area,'and <br />he did not want to pay for the sewer just for his vacant propperty. <br />Mr. Albert Tengelitsch, owner of Lots 183 through 191, stated. <br />that he was proposing to build on his lots and he had been unable <br />to get a building permit until he attempted to have sanitary sewers <br />put in. He stated that he had heard that Barrett Law may expire <br />within the year, and then property owners would have to pay the <br />full cost of such improvements. Mr. Hill and Mr. Leszczynski <br />stated that they were not aware that the Barrett Law procedure <br />would be expiring. Mr. Tengelitsch stated that he was in support <br />of the sewer construction in order that he could begin construction <br />on his lots.
